<br />CES:mmg 08/03/89 (#25/052) <br />ORIG1f~AL <br /> <br />RES 0 L UTI 0 N <br /> <br />No.III04 <br /> <br />AU6 07 1989 <br /> <br />RESOLUTION SUMMARILY VACATING A SANITARY SEWER EASEMENT <br />AND APPROVING AND AUTHORIZING ACCEPTANCE OF DEED OF <br />EASEMENT IN EXCHANGE THEREFOR <br /> <br />(PARCEL MAP NO. 88-10 SUBDIVISION) <br /> <br />WHEREAS, pursuant to the provisions of Chapter 4 (commencing <br /> <br />with ~8330), Part 3, Division 9 of the Streets and Highways Code <br /> <br />of the State of California, this Council may summarily vacate a <br /> <br />sanitary sewer easement, if such easement has been superseded by <br /> <br />relocation and there are no other public facilities located <br /> <br />within said easement; and <br /> <br />WHEREAS, a portion of a sanitary sewer easement as shown on <br /> <br />that certain map entitled "Parcel Map No. 88-10 - City of Redwood <br /> <br />City, County of San Mateo, State of California" filed September <br /> <br />16, 1989, in Book 61 of Parcel Maps at page 18, Official Records <br /> <br />of San Mateo County, shall no longer be required for public uses <br /> <br />provided that said portion be relocated; and <br /> <br />WHEREAS, the owner of record of the property affected <br /> <br />thereby proposes to convey to the City a deed of easement in <br /> <br />exchange for the portion to be vacated; and <br /> <br />WHEREAS, the value of the property interest to be received <br /> <br />by the City pursuant to said exchange equals or exceeds the value <br />of the property interest to be vacated; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> <br />AS FOLLOWS: <br /> <br />1.
