RES 0 L UTI 0 N N O. ~ ORIGfNAL RESOLUTION AUTHORIZING ISSUANCE OF LETTER PERMIT TO THE DOWNTOWN ASSOCIATION, AND REGULATING USE Of PUBLIC RIGHTS-Of-WAY IN CONNECTION THEREW ITH (DOWNTOWN fESTIVAL) BE IT RESOLVED BY THE COUNCIL Of THE CITY Of REDWOOD CITY, AS fOLLOWS: That the City Manager is authorized to issue a letter permit to the Downtown Association for a Downtown festival along portions of Broadway on September 16 and 17, 1989, in the form of Exhibit "A" hereof, attached hereto and by this reference incorporated herein

<br />- 2- <br /> <br />7. Insurance. Permittee shall furnish to the City public liability <br />and property damage insurance naming the City of Redwood City, its <br />Council, boards, commissions, officers, employees, and agents as <br />insureds, or additional insureds, insuring the same against all claims <br />for personal injury or death to any person or persons resulting or <br />arising from the conducting of the activities herein permitted, or <br />alleged to have resulted or alleged to have arisen therefrom, or from <br />any act or omission to act, of Permittee in connection therewith, in <br />the amounts of $500,000 for each person and $1,000,000 for each <br />occurrence, and property damage insurance for damage or injury to, <br />or destruction of property, including the loss of use thereof, in the <br />amount of $500,000. Evidence of such insurance coverage in form <br />satisfactory to the City shall be furnished by Permittee to the City at <br />least ten (10) days prior to commencement of the event. <br /> <br />8. Damag:e to Public Property. Permittee shall reimburse Ule <br />City for the costs for any damages to City owned property in the <br />vicinity of the designated route, caused by or arising out of, the <br />conducting of the "Wine and Art Festival" permitted hereunder, or the <br />acts, or omissions to act, of persons participating in said event. All <br />signs or other markings placed in or upon public property, including <br />the public right-of-way in connection with said "Wine and Art Festival" <br />shall be relllOved immediately following said event. <br /> <br />9. Compliance WiUI Laws. Permittee shall comply with all <br />appropriate and applicable rules, regulations and laws in connection <br />with the conducting of said event, or any activities associated <br />therewith. This permit shall be in addition to all other permits which <br />are or may be required for conducting the "Wine and Art Festival", or <br />any associated activity. <br /> <br />10. Hold Harmless. Permittee shall assume the defense of and <br />indemnify and save harmless the City of Redwood City, its Council, <br />officers, boards, commissions, employees and agents from all suits, <br />actions, damages, or claims to which the City may be subjected of any <br />kind or nature whatsoever, resulting from or arising out of the <br />performance or failure to perform of Permittee hereunder, or <br />otherwise arising from or arising out of said Race, or any activities <br />herein permitted. <br /> <br />11. Additional Matters. Additional or further matters not herein <br />described or contemplated in connection with the "Wine and Art <br />Festival" shall not be effectuated without the prior written consent of <br />the Chief of Police. <br />
