<br />DES:djk 09/21/89 (017/26) <br />DES:dj 09/25/89R <br /> <br />SEP 2 5 1989 <br />ORIGINAL <br /> <br />RES 0 L UTI 0 N <br /> <br />N 0.11154 <br /> <br />RESOLUTION AUTHORIZING AND DIRECTING RESUBMITTAL OF <br />GENERAL PLAN PURSUANT TO PUBLIC UTILITIES CODE SECTION <br />21676 <br /> <br />WHEREAS, Public Utilities Code Section 21676 provides that <br /> <br />each local agency whose general plan includes areas covered by an <br /> <br />airport land use commission plan shall submit a copy of its plan <br /> <br />or specific plans to the Airport Land Use Commission by July 1, <br /> <br />1983; and <br /> <br />WHEREAS, this Council is informed and believes the Redwood <br /> <br />City General Plan of 1975 and any and all pertinent approved <br /> <br />supplements and amendments therto, if any, were submitted to the <br /> <br />Airport Land Use Committee of the Regional Planning Commission of <br /> <br />the County of San Mateo wi thin the time specified by Public <br /> <br />Utilities Code Section 21676; and <br /> <br />WHEREAS, the petition filed in that certain pending <br /> <br />litigation captioned California Aviation Council, etc, et al. v. <br /> <br />Jack Greenalch, Mayor of the City of Redwood City, et al. (S.M. <br /> <br />Cnty. Supr. Ct. No. 343236) alleges that this City did not so <br /> <br />submit its general plan to the Airport Land Use Committee; and <br /> <br />WHEREAS, this Council deems the allegations in the aforesaid <br /> <br />peti tion to be untrue, and, further, views the petition to be <br /> <br />without merit; and <br /> <br />WHEREAS, in order to eliminate any doubt with respect to the <br /> <br />aforesaid allegations to the contrary, this Council desires to <br /> <br />authorize and direct resubmittal of the appropriate general plan; <br />
