APPEAL TO COUNCIL. <br /> Whenever the fire code official shall deny an application or refuse to grant a <br /> license or permit applied for under the provisions of this Code or revoke such <br /> license or permit after granting the same or when it is claimed that the provisions <br /> of the Fire Code do not apply or that the true intent and meaning of this Code <br /> have been misconstrued or wrongly interpreted, the applicant may appeal the <br /> decision of the fire code official to the Council within ten (10) days from the date <br /> of the decision of the fire code official. The decision of the Council on such <br /> appeal shall be final. <br /> "Section 12.35. NEW MATERIALS, PROCESSES, OCCUPANCIES <br /> REQUIRING PERMITS. <br /> The City Manager, Fire Chief and the fire code official shall act as a <br /> committee to determine and specify, after giving affected persons an opportunity <br /> to be heard, any new materials, processes or occupancies, which shall require <br /> permits, in addition to those now enumerated in the Fire Code. <br /> "Section 12.36. VIOLATIONS; PENALTIES. <br /> A. Any person, firm, corporation or entity whether as principal, agent, employee <br /> or otherwise, who shall violate or cause the violation of any of the Fire Code <br /> adopted by Section 12.7 and as amended by this Article, or shall fail to <br /> comply with any order, license, or permit made or issued thereunder, or who <br /> shall build any structure or improvement in violation of this Code or any <br /> detailed statement of specifications or plans submitted and approved <br /> thereunder, for each and every such violation and noncompliance, <br /> respectively, shall be guilty of an infraction and, shall be punishable by: <br /> 1. A fine not exceeding two hundred dollars ($200.00) for a first violation; and <br /> 2. A fine not exceeding five hundred dollars ($500.00) for a second violation <br /> of the same provision within one year from the date of the first violation; <br /> and <br /> 3. A fine not exceeding one thousand dollars ($1,000.00) for each additional <br /> violation of the same provision within one year from the date of the first <br /> violation. <br /> The imposition of any one penalty for any violation shall not excuse the <br /> violation or permit to continue.
