ORDINANCE NO. 2369 ORDINANCE AMENDING SECTION 40.4.1 OF THE MUNICIPAL CODE OF THE CITY OF REDWOOD CITY RELATING TO HISTORIC RESOURCES ADVISORY COMMITTEE The City Council of the City of Redwood City does ordain as follows: Section 1. The City Council finds as follows: As part of its initiative to reduce costs and increase organizational efficiencies, the City Council authorized a review of advisory boards, commissions, and committees and determined to make certain changes to staffing and appointments of these boards, commissions including the Historic Resources Committee. Section 2. The following sections and subsections of the Redwood City Municipal Code shown below are hereby amended by adding the text shown in bold italics (example) and deleting the text shown in strikeout (example). 10/24/2011 <br /> <br />of such member to the Committee shall be considered to be terminated; and the Committee <br />shall give notice of such vacancy to the member so terminated and to the Planning <br />Commission. <br /> <br />Section 4. <br /> The City Council finds that this Ordinance is not subject to the California <br />Environmental Quality Act (“CEQA”) and the State CEQA Guidelines (California Code of <br />Regulations, Title 14, Sections 15000 et seq., hereafter the “CEQA Guidelines”). This <br />Ordinance is not a “project” for purposes of CEQA, as that term is defined in CEQA Guidelines <br />Section 15378, because the Ordinance involves an administrative activity of the City of <br />Redwood City that will not result in direct or indirect physical changes in the environment, and <br />instead relates to general policy and procedure making of the city. Further, even if this <br />Ordinance is deemed a “project” and therefore subject to CEQA, the Ordinance is exempt under <br />CEQA Guidelines Section 15061(b) (3) because it is not a project which has the potential for <br />causing a significant effect on the environment. <br />Section 5. <br /> If any section, subsection, clause or phrase of this Ordinance is for any <br />reason held to be invalid, such decision shall not affect the validity of the remaining portion or <br />sections of the Ordinance. The City Council of the City of Redwood City hereby declares that it <br />should have adopted the Ordinance and each section, subsection, sentence, clause or phrase <br />thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses <br />or phrases be declared unconstitutional. <br /> <br />Section 6. <br /> This Ordinance shall take effect and be in force 30 days after its adoption. <br /> <br />Section 7. <br /> The City Clerk shall publish this Ordinance according to law. <br /> <br />* * * <br />ATTY/ORD.354/AMENDING SEC 40.4.1 HRAC ORD. # 2369 <br /> 2 <br />102711MUFF #305 <br /> <br />
