12/12/2011 <br /> chapter, without first obtaining State Certification and a City Certificate of <br /> Registration, or who shall violate any provision of this chapter, shall be guilty <br /> of an infraction. <br /> B. Any owner, licensee, manager, or Registered Certificate Holder in charge or <br /> in control of a massage business or Certified Massage Business or Certified <br /> Sole Proprietorship who knowingly employs a person who is not in <br /> possession of a valid, unrevoked Certificate of Registration, or who allows <br /> such persons to perform, operate, or practice within such a place of business, <br /> shall be guilty of an infraction. <br /> C. Anyone found to have violated any provision set forth herein shall be guilty of <br /> an infraction and anyone found to have violated any provision set forth herein <br /> more than three times in a twelve month period shall be guilty of a <br /> misdemeanor; however the City Attorney may reduce the penalty to an <br /> infraction. The penalties for such violations are as set forth in Section 1.7 of <br /> Chapter 1 of the Municipal Code. <br /> Section 5. This ordinance is categorically exempt from the California <br /> Environmental Quality Act pursuant because it is not a project and there is no <br /> possibility that the ordinance may have a significant effect on the environment. <br /> Section 6. If any section, subsection, clause or phrase of this <br /> Ordinance is for any reason held to be invalid, such decision shall not affect the <br /> validity of the remaining portion or sections of the Ordinance. The City Council of <br /> the City of Redwood City hereby declares that it should have adopted the <br /> Ordinance and each section, subsection, sentence, clause or phrase thereof <br /> irrespective of the fact that any one or more sections, subsections, sentences, <br /> clauses or phrases may be declared unconstitutional. <br /> Section 7. This ordinance repealing existing Chapter 18A and enacting <br /> new Chapter 18A pertaining to massage services shall take effect and be in force <br /> 30 days after its adoption. However, the effective date for purposes of repealing <br /> the City's current provisions contained in existing Chapter 18A regulating <br /> massage services and discontinuing the application of those provisions shall be <br /> July 1, 2012, and the effective date for purposes of new Chapter 18A and <br /> applying the provisions contained therein for regulating massage services shall <br /> be July 1, 2012. <br /> Section 8. This ordinance shall remain in effect only until January 1, <br /> 2016, or such other time as may be established thereafter by Cal. Business & <br /> Profession Code § 4620, and following. <br /> Section 9.
