ORDINANCE NO. 2391 AN ORDINANCE AMENDING SECTION 13.1 OF CHAPTER 13 REGARDING INCORPORATION OF SAN MATEO COUNTY ENVIRONMENTAL HEALTH CODE AND ARTICLE VII OF CHAPTER 38 TO THE MUNICIPAL CODE OF THE CITY OF REDWOOD CITY RELATING TO THE CROSS CONNECTION CONTROL PROGRAM THE COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: Section 1. The City Council finds as follows: 1. As a public water supplier, the City of Redwood City is required by state law to protect its water supply from contamination by adopting and enforcing a cross- connection control program; and 2. The costs to the City to remediate and remove contamination from the City's water supply after it has been contaminated by an occurrence of backflow from a property owner's private non-potable water supply can be substantial; and

O1/28/2013 <br /> A. Administrative Fee (Cross-Connection Reqistration Fee and Annual Test Result/Record <br /> Filinq Fee): The Customer-user owninq and/or occupyinq propertV on which backflow <br /> preventers are required to be installed shall pav to the Citv an Administrative Fee at the time <br /> the backflow preventer is first reqistered with the Citv and aqain each vear with the filinp of <br /> the test results. <br /> 8. Operational Testinq Fee: In the event the Director provides backflow preventer testinq <br /> services, persons availinq themselves of such services shall paV an Operational Testinq <br /> Fee. <br /> C. Inspection Fee: The Customer-user shall pay an Inspection Fee when the Director deems it <br /> appropriate to inspect the propertV of a Customer-user in order to carN out the purposes of <br /> this Article, includinq but not limited to inspecting anv propertv which has a water connection <br /> to the Citv's water supplv to determine whether there exists on such propertv an unreported <br /> or_unreqistered Auxiliarv Water Supply or any other condition which requires installation of <br /> backflow preventers. If the Director determines that backflow preventer installafion is <br /> required bv this Article, the owner of such propertv shall pav the Inspection Fee established <br /> bv Council Resolution and anv penalties and fines authorized this Article. If the Director <br /> determines that no condition exists on such propertv which repuires backflow preventers, no <br /> inspection fee will be charqed to the propertv owner. <br /> Sec. 38.42 Cross Connection Prohibition <br /> A. It shall be unlawful for any person to construct, install, use, keep, or maintain, or to <br /> permit, cause, or allow the construction, installation, use, or maintenance of a cross- <br /> connection. <br /> B. It shall be unlawful for any person to construct or install, or to cause to be constructed or <br /> installed, a backflow prevention assembly which does not meet pertinent requirements of <br /> Title 17 of the California Administrative Code and Article VII (Plumbing Code) of Chapter <br /> 9 of this Code and all amendments thereto, and this Article. <br /> C. It shall be unlawful for any person to operate, use or maintain, or to permit, or cause the <br /> use, operation, or maintenance of any backflow prevention assembly which is not tested <br /> at least once each calendar year. <br /> D. It shall be unlawful for any person to use, operate, or maintain, or to permit or cause the <br /> use, operation, or maintenance of any backflow prevention assembly which is not in <br /> good repair. <br /> E. Any Customer-user whose aropertv or premises with an Auxiliarv Water Supplv is not in <br /> compliance with this Article shall immediatelv inform the Director and take all required <br /> actions to come into compliance with this Article at Customer-user's expense. <br /> Sec. 38.43 Real Estate Transfer Disclosure Statement <br /> In addition to disclosures reauired bv California Civil Code Section 1102.6a, the followinp <br /> additional disclosure shall be made: Upon anv transfer of rea/property, includinq but not limited <br /> to commercial and residential real properties, bv sale, exchanqe, installment land sale contract <br /> /ease with option to purchase, or pround /ease coupled with improvements, or transfer of <br /> residential stock cooperative. the transferor shall provide to fhe buver an additional disclosure <br /> ATTY/FINAL ORD/2013/ORD.384/CROSS CONNECTION ORD.#2391 <br /> REV:01-17-13 PT FORMERLY MUFF#802 <br /> Page 11 of 13 <br />
