ORDINANCE NO. 2393 AN ORDINANCE OF THE CITY OF REDWOOD CITY ADDING ARTICLE III ("REUSABLE BAGS") TO CHAPTER 13 (ENVIRONMENTAL HEALTH CODE) OF THE REDWOOD CITY MUNICIPAL CODE THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: Section 1. Article III "Reusable Bags", consisting of new Sections 13.7 through 13.12, of Chapter 13 of the Redwood City Municipal Code (Environmental Health Code) is hereby added as follows: ARTICLE III. REUSABLE BAGS 13.7 FINDINGS AND PURPOSE The City Council finds and determines that: (a) The use of single-use carryout bags by consumers at retail establishments is detrimental to the environment, public health and welfare

03/25/2013 <br /> has been met and shall be a final administrative order, with no administrative <br /> right of appeal. <br /> (d) Failure to Pay Fine. If said fine is not paid within 30 days from the date appearing <br /> on the notice of the fine or of the notice of determination of the Director of the <br /> Environmental Health Division or his or her designee after the hearing, the fine <br /> shall be referred to a collection agency. <br /> 13.12 ENFORCEMENT <br /> (a) The San Mateo County Environmental Health Division is hereby directed to <br /> enforce the provisions of this Chapter within the geographical limits of the City of <br /> Redwood City. <br /> (b) The authorization granted by subsection (a) of this section, includes, without <br /> limitation, the authority to hold hearings and issue administrative fines within the <br /> geographical limits of the City of Redwood City. <br /> (c) Enforcement will begin effective October 1, 2013. <br /> Section 2. Severability. If any section, subsection, provision or part of this ordinance, <br /> or its application to any person or circumstance, is held to be unconstitutional or otherwise <br /> invalid, the remainder of this ordinance, and the application of such provision to other person or <br /> circumstances, shall not be affected thereby and shall remain in full force and effect and, to that <br /> end, the provisions of this Ordinance are severable. <br /> Section 3. Effective Date This ordinance shall be effective thirty (30) days after its <br /> adoption.
