09/09/2013 <br /> WHEREAS, the City has notified all of the affected property owners within the <br /> proposed modified boundaries of Middlefield Road Underground Utility District No. <br /> 2011-1 and invited same to attend a public hearing to discuss formation of the proposed <br /> district. Notice of said hearing was provided by mailing and publication in accordance <br /> with §11.42 of the code of the City of Redwood City; and <br /> WHEREAS, on August 26, 2013, at 7:00 P.M., or as soon thereafter as the <br /> matter could be heard, at the Redwood City Council Chambers, 1017 Middlefield Road, <br /> Redwood City, California, the City Council held a public hearing regarding the proposed <br /> boundary modifications of the District and received and considered the <br /> recommendations from the Community Development Director and did hear any and all <br /> public comments and objections or protests that were raised by the owners of property <br /> within the modified boundaries of the District. <br /> NOW, THEREFORE, THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS <br /> FOLLOWS: <br /> Section 1. The foregoing recitals are, and each of them is, true and correct and <br /> constitute the findings in this matter. <br /> Section 2. This project is categorically exempt from the California Environmental <br /> Quality Act (CEQA) pursuant to CEQA Guidelines Section 15302(d), Replacement or <br /> Reconstruction, as it involves the conversion of overhead utilities to underground <br /> facilities. <br /> Section 3. Section 4 of Ordinance No. 2376 is hereby amended as follows <br /> (added text shown in underline (example) and deleted text shown in strikeout <br /> (��)� <br /> "Section 4. Pursuant to Section 11.45 of the Code of the City of <br /> Redwood City, the date by which the undergrounding of all overhead <br /> utilities, including existing service drops, and the removal of all wood utility <br /> poles overhead wires and associated structures from all streets, roads, <br /> alleys or ways shall occur within said District is hereby fixed as December <br /> 31, �6 2017." <br /> Section 4. The boundaries of the Middlefield Road Underground Utility District <br /> No. 2011-1 established under Ordinance No. 2376 are hereby modified and determined <br /> as set forth and described in Amended Exhibit "A", attached hereto and by this <br /> reference incorporated herein. Reference is hereby made to the map of said District <br /> boundaries as depicted on Amended Exhibit "B", attached hereto and by this reference <br /> incorporated herein, for a general description of the District, as modified. The original <br /> Exhibit "A" and Exhibit "B" to Ordinance No. 2376 are hereby deleted and replaced with <br /> Amended Exhibit "A" and Amended Exhibit "B", respectively. <br /> ATTY/ORD.392/MIDDLEFIELD UUD DISTRICT AMENDMENT ORD.#2397 <br /> REV:08/16/13 VR Formerly MUFF#804 <br />
