01/13/2014 <br /> ORIGINAL <br /> ORDINANCE N0. 2401 <br /> AN ORDINANCE OF THE CITY OF REDWOOD CITY ADDING <br /> ARTICLE XI "RECYCLING AND SALVAGING OF <br /> CONSTRUCTION AND DEMOLITION DEBRIS" TO CHAPTER 9 <br /> (BUILDINGS) OF THE CITY OF REDWOOD CITY MUNICIPAL <br /> CODE <br /> THE COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS <br /> FOLLOWS: <br /> WHEREAS, the City is committed to protecting the public health, safety, <br /> welfare, and environment; and <br /> WHEREAS, to meet these goals, the City needs to promote the reduction <br /> of solid waste and reduce the stream of solid waste going to landfills; and <br /> WHEREAS, under California law as embodied in the California lntegrated <br /> Waste Management Act of 1989 (California Public Resources Code Sections <br /> 40000 et seq.), Redwood City is required to prepare, adopt, and implement <br /> source reduction and recycling plans to reach landfill diversion goals and is <br /> required to make substantial reductions in the volume of waste materials going to <br /> landfill, otherwise the City will face potential fines of up to ten thousand dollars <br /> ($10,000.00) per day; and <br /> WHEREAS, debris from construction, demolition, and renovation of <br /> buildings represents a significant portion of the volume of waste presently coming <br /> from the City of Redwood City, and much of this waste is particularly suitable for <br /> recycling and reuse; and <br /> WHEREAS, the City's commitment to reduce waste and to comply with <br /> State law requires the establishment of programs such as those for recycling and <br /> salvaging of construction and demolition (C&D) materials; and <br /> WHEREAS, the adoption of this Ordinance is found to be categorically <br /> exempt from CEQA pursuant to Section 15308 of the California Code of <br /> Regulations ("CEQA Guidelines"), which exempts actions taken by regulatory <br /> agencies for enhancement or protection of the environment where the proposed <br /> regulation involves procedures for the protection of the environment; and <br /> WHEREAS, the City Council of the City of Redwood City is the decision- <br /> making body for this Ordinance; and <br /> ATTY/ORD.396/C&D ORD ADDING ARTICLE XI ORD.#2401 <br /> REV:11-26-13 MLG FORMERLY MUFF#305 <br /> Page 1 of 13 <br />
