STREETS 8 HIGHWAYS CODE
§36600, ET SEQ.)
NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY DOES
ORDAIN AS FOLLOWS:
Section 1. The City Council makes the following findings:
1. Pursuant to Article XI, Section 5 of the California Constitution, the City may make
and enforce all ordinances and regulations with respect to municipal affairs,
subject only to restrictions and limitations provided in its charter; and
2. Section 3 of the City Charter provides that, except as prohibited by the state
constitution or restricted by the City Charter, the City shall and may exercise all
municipal powers, functions, rights, privileges and immunities of every name and
nature whatsoever; and
3. The creation of an assessment district to fund improvements and services of a
local nature is a quintessential municipal affair, and no specific statutory authority
is required for the creation of such an assessment district by a charter city; and
4. Section 74 of the City Charter authorizes the City to make improvements and
levy assessments in conformity with and under the authority conferred by the
general laws of the State, but does not preempt the adoption of a local
procedural ordinance unless that ordinance prevents or limits the Council from
proceeding under any of the general laws of the State; and
ATTY/ORD.400/CBID PROCEDURE ORDINANCE ORD.2405
REV:03-18-14 PT FORMERLY MUFF#506
