Adoption of this ordinance is found to be categorically exempt from
the California Environmental Quality Act because the adoption of this resolution is not a
project, in that it is a government funding mechanism which does not involve any
commitment to any specific project (CEQA Guidelines Section 15378(b)(4)), and because
it can be seen with certainty that there is no possibility that the fees may have a significant
effect on the environment, in that this ordinance contains no provisions modifying the
physical design, development, or construction of residences or nonresidential structures
(CEQA Guidelines Section 15061(b)(3)).
Section 4. If any section, subsection, sentence, clause or phrase of the
ordinance is for any reason held to be invalid, such decision shall not affect the validity of
the remaining portions of this ordinance. The City Council hereby declares that it should
have adopted the ordinance and each section, subsection, sentence, clause or phrase
thereof, irrespective of the fact that any one or more sections, subsections, sentences,
clauses or phrases be declared unconstitutional.
Section 5. The City Clerk shall publish this ordinance in accordance with
applicable law
Section 6. Effective date. This ordinance shall take effect thirty (30) days from
the date of its passage.
