09/12/2016 <br /> ORDINANCE N0. 2426 <br /> ORDINANCE ESTABLISHING AN UNDERGROUND UTILITY <br /> DISTRICT IN A PORTION OF THE CITY OF REDWOOD CITY; <br /> DESIGNATING SAID DISTRICT AS ROOSEVELT AVENUE <br /> UNDERGROUND UTILITY DISTRICT NO. 2016-1; DESCRIBING THE <br /> BOUNDARIES OF SAID DISTRICT; ESTABLISHING WHAT UTILITY <br /> FACILITIES WILL BE MAINTAINED ABOVE GROUND; AND <br /> ESTABLISHING THE TIME BY WHICH POLES AND OVERHEAD <br /> WIRES SHALL BE REMOVED AND UNDERGROUND SERVICE <br /> PROVIDED <br /> WHEREAS, the California Public Utilities Commission ("CPUC") has authorized <br /> electric and telecommunication utilities to convert overhead utility lines and facilities <br /> to underground pursuant to Electric Rule 20 and Telecommunication Rule 32; and <br /> WHEREAS , pursuant to certain criteria, CPUC rules allow participating cities <br /> to establish legislation authorizing the creation of underground utility districts within <br /> which existing overhead electric distribution and telecommunication distribution and <br /> service facilities will be converted to underground ; and <br /> WHEREAS, the City of Redwood City, has adopted an ordinance authorizing <br /> the City Council to designate areas within which all existing overhead poles, overhead <br /> wires and overhead equipment associated with the distribution of electric power, <br /> telecommunication services and cable television should be removed and replaced <br /> with underground wires and facilities; and <br /> WHEREAS, the Community Development Department for the City of Redwood <br /> City has consulted with the affected public utilities and such utilities have agreed that the <br /> proposed underground conversion district, designated Roosevelt Avenue <br /> UNDERGROUND UTILITY DISTRICT NO. 2016-1 and more particularly described in <br /> Exhibit "A" (legal description) and Exhibit "B" (Plat of Roosevelt Avenue UUD) attached <br /> hereto and incorporated herein by reference meets the criteria established by the rules of <br /> the CPUC, to wit: <br /> (a) Such undergrounding will avoid or eliminate an unusually heavy <br /> concentration of overhead electric facilities. <br /> (b) The streets, roads, alleys, or ways in the district are extensively used by <br /> the general public and carry a heavy volume of pedestrian and vehicular <br /> traffic. <br /> Page 1 of 4 <br /> ATTY/ORD.430/ROOSEVELT AVENUE UNDERGROUND UTILITY DISTRICT NO.2016-1 ORDINANCE N0.2426 <br /> REV:07-14-16 RL MUFF NO.804 <br />
