02/25/2019 <br />ORDINANCE NO. 2458 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY AMENDING ARTICLE VI OF CHAPTER 2 OF THE REDWOOD <br />CITY MUNICIPAL CODE (UNCLAIMED PROPERTY) <br />WHEREAS, California Civil Code Section 2080.6 authorizes the City to elect to <br />be governed by California Civil Code Sections 2080 through 2080.10 with respect to <br />disposition of unclaimed personal property or, in the alternative, to adopt reasonable <br />regulations for the care, restitution, sale or destruction of such unclaimed property; and <br />WHEREAS, California Welfare and Institutions Code Section 217 authorizes the <br />City to adopt an ordinance providing that any personal property with a value of not more <br />than Five Hundred Dollars ($500) and which has been unclaimed for a period of at least <br />ninety (90) days may, instead of being sold at public auction to the highest bidder <br />pursuant to the provisions of Section 2080.5 of the Civil Code, be donated to qualifying <br />organizations; and <br />WHEREAS, Government Code Sections 50050 through 50055 provides for a <br />procedure for the disposition of unclaimed money in in the City's treasury or in the official <br />custody of the City's officers; and <br />WHEREAS, Article VI of Chapter 2 of the Redwood City Municipal Code <br />(Unclaimed Property) sets forth procedures for the disposition of unclaimed property in <br />the possession of the Redwood City Police Department; and <br />WHEREAS, pursuant to the City's Administrative Policy No. 43, the City follows <br />the procedures in Government Code Sections 50050 through 50055 for the disposition <br />of unclaimed money in in the City's treasury or in the possession of the Redwood City <br />Police Department; and <br />WHEREAS, Article VI of Chapter 2 of the Redwood City Municipal Code <br />(Unclaimed Property) generally requires the Redwood City Police Department to hold <br />onto unclaimed property for longer than what is required by California Civil Code <br />Sections 2080 through 2080.10; and <br />WHEREAS, it is in the best interest of the City to elect to be governed by <br />California Civil Code Sections 2080 through 2080.10 with respect to disposition of <br />unclaimed personal property, excluding unclaimed money, because of the limited <br />capacity in the Redwood City Police Department's Property & Evidence Storage room <br />and the fiscal impact of offsite storage; and <br />WHEREAS, Article VI of Chapter 2 of the Redwood City Municipal Code <br />authorizes the donation of bicycles and toys unclaimed for a period of at least sixty (60) <br />days to qualifying organizations; and <br />ATTY/ORD.450/ORD I NANCE AMENDING CHAPTER 2—ARTICLE VI UNCLAIMED PROPERTY ORDINANCE NO. 2458 <br />REV: 01-03-18 MI MUFF NO. 305 <br />Page 1 of 4 <br />
