05/06/2019 ORDINANCE NO. 2459 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AMENDING REDWOOD CITY CODE CHAPTER 2 (ADMINISTRATION), ARTICLE IX (BOARDS AND COMMISSIONS) AND CHAPTER 45 (PUBLIC ART) TO UPDATE THE POWERS, DUTIES AND TERM LIMITS OF THE CIVIC CULTURAL COMMISSION AND TO CHANGE ITS NAME TO THE ARTS COMMISSION WHEREAS, the proposed amendments to Redwood City Code Chapter 2 (Administration), Article IX (Boards and Commissions) and Chapter45 (Public Art) set forth herein ("Ordinance Amendment') would update the powers and duties of the Civic Cultural Commission and change its name to the Arts Commission. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: Section 1. The City Council hereby finds that the proposed Ordinance Amendment is in the public interest as described in the staff report. Section 2. This proposed Ordinance Amendment has been reviewed with respect to applicability of the California Environmental Quality Act ("CEQA") and the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.). The Ordinance Amendment is not a project under CEQA Guidelines Section 15378 because it involves organizational or administrative activities that will not result in direct or indirect physical changes in the environment. Section 3. If any section, subsection, clause or phrase of this Ordinance Amendment is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion or sections of the Ordinance Amendment. The City Council of the City of Redwood City hereby declares that it would have adopted the Ordinance Amendment and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 4. The City Council of the City of Redwood City adopts the following amendments to Redwood City Code Chapter 2 (Administration), Article IX (Boards and Commissions) and Chapter 45 (Public Art) by adding the text shown in underline (example) and deleting the text shown in strikeout (example), as provided in Exhibit A. Wording in brackets ([example]) is informational only and is not to be included in the published ordinance. (Exhibit A). Section 5. The City Council of the City of Redwood City hereby amends Redwood City Code Chapter 45 (Public Art) by replacing all references to the Civic Cultural Commission with the Arts Commission. Section 6. This Ordinance shall go into effect 30 days following its adoption.
