05/06/2019 <br />Sec. 33A.10. - STANDARDS FOR ISSUANCE OF A PERMIT UNDER THIS ARTICLE: <br />A. A block party permit shall be issued by the Chief of Police <br />if he/she <br />finds that all of the following circumstances exist: <br />A-1.The applicant has not knowingly and with intent to deceive, made any false, <br />misleading or fraudulent statements of material fact in the application for a permit <br />or in any other document required pursuant to this Article; <br />43-.2.The applicant has met the standaFds in requirements of Section 33A.3(A), <br />Section 33A.4 through Section 33A.6, Section 33A.7(A), and Section 33A.8 <br />through Section 33A.9 of this Article, and paid in advance any fee required and <br />agrees to such conditions as are imposed in the permit; <br />G.3.The time, duration and size of the temporary street closure will not substantially <br />disrupt the orderly and safe movement of other traffic; <br />QA.The temporary street closure is of a size or nature such that it will not require the <br />diversion of so great a number of police officers of the City to properly police the <br />areas contiguous thereto, so as to prevent normal police protection to the City; <br />€-5.The concentration of persons will not unduly interfere with proper fire and police <br />protection of, or ambulance service to, areas contiguous to such street closure; <br />6.The temporary street closure will not interfere with the movement of fire -fighting <br />equipment en route to a fire; <br />6-7.The temporary street closure will not unduly interfere with the orderly operation <br />of parks, hospitals, churches, schools or other public and quasi -public institutions <br />in the City; <br />H- .The applicant has provided reasonable means for informing all persons listed in <br />Section 33A.3JAh and all persons participating in a temporary street closure of <br />the terms and conditions of such permit and the applicable laws thereto; <br />1.9. The temporary street closure will not conflict with or interfere with another <br />temporary street closure for which a permit has been granted and <br />10. A majority of owners, residents, or tenants of the properties fronting the street <br />to be closed have given written consent to the temporary street closure. <br />B. A special event permit (excluding within the Courthouse Square Event Area) shall be <br />issued by the Chief of Police if he/she finds that all of the following circumstances exist: <br />1. The applicant has not knowingly and with intent to deceive, made any false, <br />misleading or fraudulent statements of material fact in the application for a permit <br />or in any other document required pursuant to this Article; <br />2.
