4/24/00 <br />Section 18.251 - Refund o,,_~aes Paid: , <br /> <br /> A. If a building permit or other entitlement for a Development expires without <br /> commencement of construction, then the Fee Payer shall be entitled to a refund, <br /> without interest, of the Impact Fee paid as a condition for its issuance, except <br /> that the City shall retain two pement (2%) of the fee to offset a portion of the <br /> costs of collection and refund. The Fee Payer shall apply in writing for such a <br /> refund within thirty (30) calendar days of the expiration of the permit; provided, <br /> that the Administrator may extend such period for good cause, not to exceed six <br /> (6) months. <br /> <br /> B. Any funds not expended or encumbered by the end of the calendar quarter <br /> immediately following five years from the date an Impact Fee was paid, upon <br /> written application of the then current landowner of the Development for which <br /> the Impact Fee was paid, shall be returned to such landowner with interest at a <br /> rate equal to the average rate of interest earned by the 'City on deposits of City <br /> funds in the Local Agency Investment Fund of the State of California during the <br /> twelve (12) month period next preceding the date of written application for refund; <br /> provided, that the landowner shall have submitted such application to the <br /> Administrator within one hundred eighty (180) calendar days from the expiration <br /> of the five-year period, unless the Council shall have extended the expenditure <br /> period. <br /> <br />Sh/Council/0rd ] ~) <br />0rd-105 <br />FXS/ss <br />03/28/00 <br />DES:rg:04/13/OOR; 04/17/00R <br /> <br /> 2191 <br /> <br /> <br />
