unlawful or an offense; or the doing of any act is required or the failure to do any <br />act is declared to be unlawful, and such act is declared to be unlawful, and such <br />act is declared to be an infraction, and where no specific penalty is provided <br />therefore, the violation of any such provision of this ordinance, shall be punished <br />by: <br /> <br /> 1. A fine not exceeding one hundred dollars ($100) for a first <br /> <br /> violation; <br /> <br /> 2. A fine not exceeding two hundred dollars ($200) for a second <br /> violation of the same provision or of this ordinance within one <br /> year; <br /> <br /> 3. A fine not exceeding five hundred dollars ($500) for each <br /> <br /> additional violation of the same provision or of this ordinance <br /> within one year. <br /> <br /> B. Any person violating Section 44.4 of this Ordinance shall, upon <br />conviction, be guilty of an infraction, and be punished by a fine of not to exceed <br />two hundred fifty dollars ($250.00). <br /> <br /> C. Any person violating sections 44.8 of this ordinance shall, upon <br />conviction, be punished by a fine not exceeding one thousand dollars <br />($1,000.00) or imprisonment for a term not exceeding six (6) months, or by both <br />such fine and imprisonment, except that any person convicted of throwing, <br />placing or introducing any oil into the waters of the harbor or along the shore <br />thereof or upon any land within the Harbor shall also be liable civilly in an amount <br />not exceeding six thousand dollars ($6,000) and, in addition, shall be liable to <br /> <br />F:Atty/Ord/Ord.149 12 <br />050702 <br /> <br /> 2225 <br /> <br /> <br />
