ORDINANCE NO. 2245 ORDINANCE AMENDING ARTICLES II AND III OF CHAPTER I OF THE REDWOOD CITY MUNICIPAL CODE PROVIDING FOR ADMINISTRATIVE CODE ENFORCEMENT THE CITY COUNCil OF REDWOOD CITY DOES HEREBY ORDAIN AS FOllOWS: Section 1. FindinQs. A. Enforcement of the Municipal Code is vital to the protection of the public's health, safety and quality of life. B. The City Council of the City of Redwood City recognizes that successful code enforcement starts with the drafting of precise regulations that can be effectively applied in administrative enforcement hearings and judicial proceedings

<br />2. <br /> <br />The frequency of recurrence of the violation. <br /> <br />3. <br /> <br />The seriousness of the violation. <br /> <br />4. <br /> <br />The history of the violation. <br /> <br />5. <br /> <br />The Responsible Party's conduct after issuance of the <br />Notice and Order. <br /> <br />6. <br /> <br />The good faith effort by the Responsible Party to comply. <br /> <br />7. <br /> <br />The economic impact of the penalty on the Responsible <br />Party. <br /> <br />8. <br /> <br />The impact of the violation upon the community. <br /> <br />9. <br /> <br />Any other factors that justice may require. <br /> <br />(d) The City Manager has the authority to establish a penalty <br />schedule and procedures for Enforcement Officers or for Administrative Hearing <br />Officers to use as a guideline in determining the amount of Administrative Civil Penalties <br />in appropriate cases. <br /> <br />(e) The maximum amount of Administrative Penalties will be set <br />forth by resolution of the City Council. <br /> <br />1.30.5 Administrative Costs. <br /> <br />An Enforcement Officer or Administrative Hearing Officer is authorized to <br />assess any reasonable administrative costs. Administrative costs may include <br />scheduling and processing of the hearing and all subsequent actions related to the <br />hearing. <br /> <br />1.30.6 Failure to Comply With an Administrative Civil Penalties Notice <br />and Order. <br /> <br />An Enforcement Officer will request the City Manager to appoint an <br />Administrative Hearing Officer and to establish a date, time and place for the <br />Administrative Civil Penalties hearing in accordance with this Section 1.30 when the <br />Responsible Party fails to comply with the terms of the Notice and Order. Failure to <br />comply includes failure to pay the assessed Administrative Civil Penalties, failure to <br />commence and complete corrections by the established deadlines or failure to refrain <br />from continuing violations of the Municipal Code. <br /> <br />F:Atty/Ord/Ord.157.1 <br />052303 <br /> <br />15 <br />
