ORDINANCE NO. 2245 ORDINANCE AMENDING ARTICLES II AND III OF CHAPTER I OF THE REDWOOD CITY MUNICIPAL CODE PROVIDING FOR ADMINISTRATIVE CODE ENFORCEMENT THE CITY COUNCil OF REDWOOD CITY DOES HEREBY ORDAIN AS FOllOWS: Section 1. FindinQs. A. Enforcement of the Municipal Code is vital to the protection of the public's health, safety and quality of life. B. The City Council of the City of Redwood City recognizes that successful code enforcement starts with the drafting of precise regulations that can be effectively applied in administrative enforcement hearings and judicial proceedings

<br />(e) The City Clerk will fix a time, date, and place for hearing <br />such report and any protests or objections thereto by the City Council. <br /> <br />(f) The Finance Director will cause written notice to be served <br />on each property owner whose interest is disclosed by the current county equalized <br />assessment roll not less than ten (10) calendar days prior to the time set for the hearing. <br /> <br />1.45.2 Public Hearing and Protests of Proposed Liens. <br /> <br />(a) Any person owning a legal or equitable interest in real <br />property proposed to be subject to a lien pursuant to this Article may file a written <br />protest with the City Clerk and/or may protest orally at the City Council hearing. <br /> <br />(b) Each written protest or objection must contain a description <br />of the property in which the protesting party has a legal or equitable interest and the <br />grounds of such protest or objection. The grounds for protest or objection, and any <br />evidence or testimony submitted in support or in opposition to the imposition of a lien, <br />will be confined to whether the amount of any Administrative Penalty and/or <br />Administrative Cost imposed was satisfied in full within the time allowed by law and/or <br />successfully challenged by a timely writ of mandate. <br /> <br />(c) The City Council, after the hearing, will adopt a resolution <br />confirming, discharging, or modifying the amount of lien based upon evidenced <br />produced at the hearing. <br /> <br />1.45.3 Recording of Lien. <br /> <br />Within thirty (30) calendar days following the adoption of a <br />resolution by the City Council imposing a lien, the City Clerk will file the same as a <br />judgment lien in the office of the County Recorder of San Mateo County. The lien may <br />carry such additional administrative charges as set forth by resolution of the City <br />Council. <br /> <br />1.45.4 Satisfaction of Lien. <br /> <br />Once payment in full is received by the City for outstanding <br />penalties and costs, the City Clerk will either record a notice of satisfaction or provide <br />any property owner or financial institution having a legal or equitable interest in the <br />property with a notice of satisfaction so they may record this notice with the office of the <br />County Recorder. Such notice of satisfaction will cancel the City's lien. <br /> <br />Section 3. <br /> <br />That Article III of Chapter 1 of the Redwood City Municipal Code is <br /> <br />hereby repealed in its entirety. <br /> <br />F:Atty/Ord/Ord.157.1 <br />052303 <br /> <br />21 <br />
