ORDINANCE NO. 2245 ORDINANCE AMENDING ARTICLES II AND III OF CHAPTER I OF THE REDWOOD CITY MUNICIPAL CODE PROVIDING FOR ADMINISTRATIVE CODE ENFORCEMENT THE CITY COUNCil OF REDWOOD CITY DOES HEREBY ORDAIN AS FOllOWS: Section 1. FindinQs. A. Enforcement of the Municipal Code is vital to the protection of the public's health, safety and quality of life. B. The City Council of the City of Redwood City recognizes that successful code enforcement starts with the drafting of precise regulations that can be effectively applied in administrative enforcement hearings and judicial proceedings

<br />(3) <br /> <br />The printed name and signature of the Enforcement Officer. <br /> <br />(4) Language requiring the Responsible Party to immediately <br />correct the violations, the method of correction and an explanation of the <br />consequences of failing to correct the violations. <br /> <br />(5) The amount of the penalty for the Code violation and the <br />consequences of failure to pay the penalty. <br /> <br />(6) A description of the penalty payment process, including a <br />description of the time within which, and the place to which, the penalty will be <br />paid. <br /> <br />(7) <br /> <br />Identification of appeal rights. <br /> <br />1.20.3 Building, Plumbing, Electrical and Zoning Violations. <br /> <br />Prior to the issuance of an administrative citation for a violation which <br />pertains to building, plumbing, electrical, or similar structural or zoning matters and that <br />does not create an immediate danger to health or safety, the Enforcement Officer will <br />provide a reasonable period of time of not less than five (5) business days, to correct or <br />otherwise remedy the violation. <br /> <br />1.20.4 Administrative Citation Penalties Assessed. <br /> <br />(a) All administrative citation penalties assessed will be payable to the <br />City through its Finance Director within thirty (30) days from the date of the <br />administrative citation. <br /> <br />(b) Payment of the administrative citation penalty will not excuse the <br />failure to correct the violations nor will it bar further enforcement action by the City. <br /> <br />(c) If the Responsible Party fails to correct the violations, subsequent <br />administrative citations may be issued for the same violations. The amount of the <br />administrative citation penalty will increase at a rate specified by resolution of the City <br />Council. <br /> <br />1.20.5 Failure to Pay Administrative Citation Penalties. <br /> <br />(a) The failure of any person to pay the penalties assessed by an <br />administrative citation or sustained by an Administrative Hearing officer within the <br />specified time may result in the City filing a claim with the Superior Court of California, <br />County of San Mateo, Small Claims Division or other appropriate Division. <br />Administrative citation fines and any amounts sustained by the Administrative Hearing <br />Officer are a debt owed to the City. <br /> <br />F:Atty/Ord/Ord.157.1 <br />052303 <br /> <br />8 <br />
