12/01/2003 ORIGINAL ORDINANCE NO. 2259 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AMENDING SECTION 32.75 OF THE MUNICIPAL CODE OF THE CITY OF REDWOOD CITY, PROVIDING FOR AN INCREASE IN THE UNIFORM TRANSIENT OCCUPANCY TAX FROM EIGHT PERCENT (8%) TO TEN PERCENT (10%). WHEREAS, the City Council of the City of Redwood City submitted Ballot Measure "F" to the voters on November 4, 2003, asking if Section 32.75 of the Municipal Code of the City of Redwood City should be amended to increase the uniform transient occupancy tax by two percent (2%); and WHEREAS, a majority of voters of the City of Redwood City approved Measure "F" to increase the uniform transient occupancy tax. NOW THEREFORE BE IT ORDAINED AS FOLLOWS: Section 1. Section 32.75 of the Municipal Code is hereby amended to read as follows: Sec. 32.75. IMPOSITION; AMOUNT; WHERE PAYABLE: For the privilege of occupancy in any hotel, each transient is subject to and shall pay a tax in the amount of ten percent (10%) of the rent charged by the operator. Said tax constitutes a debt owed by the transient to the City which is extinguished only by payment to the operator or to the City. The transient shall pay the tax to the operator of the hotel at the time the rent is paid. If the rent is paid in installments, a proportionate share of the tax shall be paid with each installment. The unpaid tax shall be due upon the transient's ceasing to occupy space in the hotel. If for any reason the tax due is not paid to the operator of the hotel, the tax administrator may require that such tax shall be paid directly to the tax administrator. (Ord. No. 1265, § 1; Ord.
