<br />ORIGINAL <br /> <br />ORDINANCE NO. 2312 <br /> <br />ORDINANCE TO ADD SECTION 38.15 TO THE CODE OF THE <br />CITY OF REDWOOD CITY RELATING TO WATER CAPACITY <br />CHARGE <br /> <br />THE COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS <br />FOLLOWS: <br /> <br />SECTION 1. Section 38.15 is added to the Redwood City Municipal Code, to <br />read as follows: <br /> <br />Sec. 38.15. WATER CAPACITY CHARGE: <br /> <br />PURPOSE <br />THIS ORDINANCE is adopted in light of the following fact and circumstances, <br />which are hereby found and declared by the Council: <br /> <br />1. The City of Redwood City Public Financing Authority has issued over $72 <br />million in revenue bonds, pursuant to authorization of the Council by resolution <br />adopted January 23, 2006. <br /> <br />2. The proceeds of the bonds are to be used to construct facilities for the <br />production and distribution of tertiary-treated disinfected recycled water for <br />landscape irrigation and industrial uses and to install artificial surfaces on athletic <br />fields in the City (the "Project"). <br /> <br />3. The purposes of the Project are to reduce the demand for potable water, <br />which is available in only a limited amount from the City and County of San <br />Francisco, and to provide an alternative source of supply. <br /> <br />4. The Project allows the City's water system to accommodate water <br />demand. It is therefore appropriate that new development contribute a fair share <br />toward the cost of the Project (which otherwise would disproportionately fall upon <br />existing customers through water consumption rates). <br /> <br />5. The water capacity charge adopted by this Ordinance has been <br />considered at a public hearing held by the City Council on June 4,2007, <br />2007. Information supporting the capacity charge has been made available for <br />public review and notice of its availability has been provided as required by law. <br /> <br />A. ESTABLISHED.
