<br />account of the earliest stipulated rent, nor shall any endorsement or statement on <br />any check or any letter accompanying any check or payment as rent be deemed <br />and accord and satisfaction, and Lessor may accept such check or payment <br />without prejudice to Lessor's right to recover the balance of such rent or pursue <br />any other remedy in this Agreement provided. <br /> <br />28.16 Permits and Aoorovals. All government permits or approvals are required. <br />Approval by Lessor of any action requiring approval does not constitute approval <br />by the City of Redwood City of any required permits or applications, and in no <br />way limits the discretion of the City in the permit, regulatory, and approval <br />process. Lessor and Lessee will render to each other reasonable assistance in <br />obtaining necessary City and other governmental permits or approvals. <br /> <br />Any consent or approval of the City of Redwood City for any permit, application, <br />or regulatory matter does not constitute consent or approval by the Lessor under <br />the terms of this lease. <br /> <br />29. INSURANCE REQUIREMENTS <br /> <br />29.1 Prior to the opening date, Lessee must provide Lessor the following insurance <br />requirements. Lessee at its sole cost and expense, shall insure its activities in <br />connection with this Agreement and obtain, keep in force and maintain insurance <br />as follows: <br /> <br />(a) Comprehensive or Commercial Form General Liability Insurance that is at <br />least as broad as the Insurance Service Office (ISO) Form No. CG 00 01 <br />(contractual liability and fire legal liability included) with minimum limits as <br />follows <br /> <br />1. Each Occurrence: One Million Dollars ($1,000,000) <br /> <br />2. Products/Completed Operations Aggregate: One Million Dollars <br />($1,000,000) <br /> <br />3. General Aggregate: Two Million Dollars ($2,000,000) <br /> <br />4. Fire Legal Liability to at least One Million Dollars ($1,000,000) <br /> <br />(b) <br /> <br />Business Automobile Liability Insurance that is at least as broad as the <br />ISO Form No. CA 00 01 for owned, scheduled, non-owned, or hired <br />automobiles with a combined single limit of not less than One Million <br />Dollars ($1,000,000) per occurrence. <br /> <br />(c) <br /> <br />Workers' Compensation and Employers Liability Insurance in a form and <br />amount covering Lessee's full liability under the Workers' Compensation <br />Act of the State of California as amended from time to time. <br /> <br />(d) <br /> <br />Property Insurance, on an ISO Special Coverage Form or its equivalent in <br />an amount sufficient to reimburse Lessee at replacement cost for all of its <br />equipment, trade fixtures, inventory, fixtures and other personal property <br />located on or in the Premises and lease improvements hereinafter <br /> <br />ATTY/AGR/2007.067 <br />103107 <br /> <br />18 <br />
