<br />The Director is authorized to attach reasonable time, place and manner conditions, <br />consistent with this Code to the issuance of a Courthouse Square Event Permit. <br /> <br />Violation of Permit Conditions <br /> <br />Whenever a Permittee or those under the control of the Permittee violate any condition <br />contained in the permit, the Police Department, Community Development Director or <br />his/her designee may revoke the permit. It shall be unlawful for any person to continue <br />to engage in an activity for which a permit was required and issued after the permit has <br />been revoked pursuant to this Section, provided, however, tha~no person shall be in <br />violation of this Code until notice has been given that the permit has been revoked. <br /> <br />Permit-Denial or Revocation <br /> <br />The Director may deny any application for a Courthouse Square Event Permit or revoke <br />a Courthouse Square Event Permit for any of the following grounds: <br /> <br />1. Fraud, misrepresentation, or any false statement orinformation contained in the <br />application for the Courthouse Square Event Permit or in the carrying out of the <br />Courthouse Square event in a way not consistentwith the application; <br /> <br />2. Failure to comply with the provisions of this Code; <br /> <br />3. Failure to comply with the conditions of the Courthouse Square Event Permit, <br />including without limitation, failure to pay applicable fees, failure to provide <br />indemnification or ins\,trance certificate or security deposit within the times <br />required, or failure to comply with all other permit requirements, licensing <br />requirements, or regulations required to conduct the activities described as a part <br />of the Courthouse SqIJare Event Permit, in the permit application or any <br />amendment thereto; <br /> <br />4. Unavailability of the Courthouse Square or any substantial portion of the Square <br />is not available dueto fire, casualty, maintenance activity or public emergency; <br /> <br />5. UnavaUability of the proposed Courthouse Square event will conflict with due to <br />previously approved scheduled events scheduled by the City for use of the <br />Square; or <br /> <br />6. The applicant has damaged City property in cases where the City has not been <br />paid in full for such damage, or has other outstanding and past due debts owed <br />to the City. <br /> <br />The notice of decision shall state the grounds for denial of the application or revocation <br />of the Courthouse Square Event Permit. <br /> <br />Application Appeal <br /> <br />Page 9 of 12 <br />
