<br />6. LICENSE AREA MAINTENANCE COSTS, REPAIR AND UTILITIES
<br />6.1 Chairs and Tables. At the commencement of the license term, 16 tables and 32
<br />chairs will be provided by the Licensor for Licensee use and shall be available to
<br />the public without purchase requirement during the Licensor's hours of operation.
<br />Licensee will clean and bus the tables and chairs. Should any or all of the tables
<br />and chairs be moved outside the Licensee's assigned license area, Licensor
<br />shall not be liable to return said tables and chairs to the Licensee.
<br />
<br />6.2 Trash and Recyclina Receptacles. Licensee will provide, at his/her own
<br />expense, adequate receptacles for trash and recycling within the license area,
<br />and ensure that receptacles do not become overfilled during hours of operation.
<br />Licensee will maintain and empty these receptacles into containers which shall
<br />be designated by the Licensor.

<br />6.3. Licensor Responsibility to Pavilion Structure. The Licensor shall provide and
<br />maintain services to the following items: roof, pavilion exterior and foundations,
<br />window frame maintenance, exterior electrical lighting facilities, structural
<br />portions of the pavilion, and rain-gutters, flashings and downspouts, unless such
<br />maintenance and repair are caused in part or in whole by the act, neglect, fault or
<br />omission of any duty by Licensee, its agents, officers, employees, contractors,
<br />servants, invitees or guests, in which case Licensee shall pay to Licensor the
<br />reasonable costs for such maintenance or repairs.

<br />6.4 Licensor Responsibility to Common Area. Licensor shall repair and sweep
<br />sidewalks, landscape maintenance, restroom maintenance and upkeep, sanitary
<br />systems, storm drainage systems, police or security services, exterior common
<br />area electrical lighting facilities, exterior common area trash and debris removal,
<br />common area cleaning / power washing, and water and sewer services for the
<br />area outside the Lessee's assigned lease and license areas, unless such
<br />maintenance and repair are caused in part or in whole by the act, neglect, fault or
<br />omission of any duty by Lessee, its agents, officers, employees, contractors,
<br />servants, invitees or guests, in which case Licensee shall pay to Licensor the
<br />reasonable costs for such maintenance or repairs.

<br />7. COMMON AREAS
<br />7.1 Non-Exclusive Use. Licensee shall have the non-exclusive right to use, in
<br />common with other vendors on Courthouse Square any and all areas and
<br />facilities that are outside the boundaries of the License Area 1 B and are within
<br />the perimeter of Courthouse Square. Said areas that are provided and
<br />designated by Licensor, in Licensor's sole discretion, are for the general and
<br />common use and convenience of Licensee, Licensor's employees, tenants of the
<br />Courthouse building, other vendors of Courthouse Square and their respective
<br />representatives, and the general public. Common areas include, but are not
<br />limited to pavilion breezeways, fountains, stairways and access ways, loading
<br />and unloading areas, trash areas, ramps, platforms, public restrooms,
<br />landscaped areas and common walkways and sidewalks necessary for access to
<br />the Courthouse Square and the Courthouse building.

<br />7.2 Rules and Reaulations - Chapter 33 Ordinance. Licensor reserves the right to
<br />exercise control and management of the common areas and may establish,
<br />modify, change and enforce such reasonable rules and regulations (as specified
