2016 MAY 07 1990 --------- ORDINANCE REPEALING ARTICLE V OF CHAPTER 32 OF THE CODE OF THE CITY OF REDWOOD CITY AND ADDING ARTICLE V (COMMENCING WITH SECTION 32.101) TO THE CODE OF THE CITY OF REDWOOD CITY RELATING TO BUSINESS LICENSE TAXES THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION l. Article V (conunencing with Section 32.101), entitled "Business Licenses", of Chapter 32 of the Code of the City of Redwood City is hereby repealed. SECTION 2. Article V (conunencing with Section 32.101) is hereby added to the Code of the City of Redwood City to read as follows: "ARTICLE V. BUSINESS LICENSES

<br /> DES:djk f'l4/16/90 (038/7) <br />City of Redwood City and any person carrying on any business <br />without first having obtained a license so to do shall be <br />liable to an action in the name of said City in any court of <br />competent jurisdiction for the amount of the license tax and <br />penalties imposed on such business. " <br /> "Section 32.137. Error by City Not to Prevent <br />Collection of Due and Payable Tax. In no case shall any <br />mistake made by the Director in stating the amount of a <br />license tax prevent or prejudice the collection by the City <br />of what shall be actually due from anyone carrying on a <br />business subject to a license tax under this article." <br /> "Section 32.138. Liability of Persons Engaged in <br />Business to Pay Tax. In any action brought under or arising <br />out of any of the provisions of this article, or of any <br />ordinance imposing a license tax, the fact that a party <br />thereto represented him or herself as engaged in any <br />business or calling for the transaction of which a license <br />is required, shall be conclusive evidence of the liability <br />of such party to pay the license tax for such business." <br /> "Section 32.139. Violation of Article Deemed <br />Misdemeanor. Each and every day or fractional part of a day <br />that the trade, calling, business, profession or occupation <br />specified in this article is conducted, carried on or <br />engaged in, or the thing done, without a license as required <br />by this article, shall constitute a violation of this <br />article, and any person who shall violate any of the <br />provisions of this article shall be deemed guilty of a <br /> 21 <br /> 2016 <br /> ,..--.----. <br />
