Description
ORDINANCE REPEALING ARTICLE XIII OF CHAPTER 18 OF THE CODE OF THE CITY OF REDWOOD CITY AND ADDING ARTICLE XIII TO CHAPTER 18 OF THE CODE OF THE CITY OF REDWOOD CITY RELATING TO THE ACQUISITION AND CONSTRUCTION OF PUBLIC IMPROVEMENTS PURSUANT TO REIMBURSEMENT AGREEMENTS; AND REPEALING ORDINANCE NO. 2003 THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Article XIII entitled, "Reimbursement Agreements" of Chapter 18 of the Code of Redwood City is repealed. SECTION 2. Article XIII ( "Reimbursement Agreements" ) is hereby added to Chapter 18 of the Code of the City of Redwood to read as follows: "ARTICLE XIII. REIMBURSEMENT AGREEMENTS

<br /> DES:dft 8/21/91R (006/10) <br /> 8/26/91R <br />Owner - means the owner of record, as shown on the last <br />equalized assessment roll of the County Assessor, <br />County of San Mateo, of property located within the <br />Benefit Area described in a Reimbursement Agreement. <br />Reimbursement Agreement - means an agreement entered <br />into with an Applicant pursuant to the provisions of <br />this Article. <br />Reimbursement Charge - means that charge determined <br />pursuant to the provisions of this Article which is <br />imposed as a condition of issuance of a permit or other <br />entitlement to connect to, gain access to, or use, an <br />Improvement acquired or constructed pursuant to the <br />provisions of this Article, or otherwise imposed as a <br />condition of issuance of a building permit, use permit, <br />planned development permit or other entitlement for the <br />use or development of Benefited Property, which charge <br />shall be collected by the City and payable to the <br />Applicant pursuant to a Reimbursement Agreement. <br />Supplemental Improvements - means that portion of the <br />Improvements which are supplemental to, and which <br />exceed the size, capacity, number, or length of the <br />improvements necessary to serve the property owned by <br />the Applicant, the cost of which shall be reimbursable <br />to the Applicant through the collection and payment of <br />Reimbursement Charges. <br /> 6 <br />
