ORDINANCE NO. 2090 ORDINANCE ADDING CHAPTER 27A TO THE CODE OF THE CITY OF REDWOOD CITY, RELATING TO THE STORMWATER MANAGEMENT AND DISCHARGE CONTROL PROGRAM THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 27A is hereby added to the Code of the City of Redwood City to read as follows: "CHAPTER 27A. "STORMWATER MANAGEMENT AND DISCHARGE CONTROL PROGRAM "ARTICLE I. General. "Section 27A.1. Purpose and Intent. The purpose of this Chapter is to ensure the future health, safety, and general welfare of the citizens of the City of Redwood City

FXS :dft ~/22/94R(030/11) <br /> ~/20/94R <br /> 5/05/95R <br /> <br /> preparing and bringing legal action under this <br /> Section. <br /> <br /> (c) Costs incurred in removing, correcting, or <br /> terminating the adverse effects resulting from <br /> the violation, including reasonable attorney's <br /> fees and court. <br /> <br /> (d) Compensatory damages for loss or destruction <br /> to water quality, wildlife, fish and aquatic <br /> life. Assessments under this subsection shall <br /> be paid to the City to be used exclusively for <br /> costs associated with monitoring and <br /> establishing stormwater discharge pollution <br /> control systems and/or implementing or <br /> enforcing the provisions of this Chapter. <br /> <br /> (3) Cease and Desist Orders. When an authorized <br />Enforcement Official finds that a discharge has taken place <br />or is likely to take place in violation of this Chapter, the <br />official may issue an order to cease and desist such <br />discharge, or practice, or operation likely to cause such <br />discharge and direct that those persons not complying shall: <br />(i) comply with the requirement; (ii) comply with the time <br />schedule for compliance, and/or (iii) take appropriate <br />remedial or preventive action to prevent the violation from <br />recurring. <br /> <br /> (4) Notice to Clean. Whenever an authorized <br />Enforcement Official finds any oil, earth, dirt, grass, <br />weeds, dead trees, tin cans, rubbish, refuse, waste or any <br />other material of any kind, in or upon the sidewalk abutting <br />or adjoining any parcel of land, or upon any sidewalk <br />abutting or adjoining any parcel of land or grounds, which <br />may result in an increase in pollutants entering the <br />Stormwater Drainage System, he or she may give notice to <br />remove such oil, earth, dirt, grass, weeds, dead trees, tin <br />22 <br /> <br /> <br />
