persons interested in the matter were heard or afforded an opportunity to be heard <br /> thereon. <br /> <br /> (c) This Council has reviewed and considered all relevant information, <br /> including the evidence, both oral and documentary, made and submitted at the <br /> public hearings on the proposed Development Agreement, and on the <br /> Development Agreement as revised, such evidence including the Master Plan for <br /> the Electronic Arts Headquarters dated December, 1995, a copy of which is on file <br /> with the City Clerk and incorporated herein by reference; and all other matters <br /> deemed material and relevant to the proposed Development Agreement. <br /> <br /> Section 3. In consideration of the foregoing findings, this Council hereby <br />concludes and declares that the Development Agreement as revised is consistent with the <br />General Plan of the City of Redwood City. The "Findings of Consistency Between the <br />Electronic Arts Master Plan Project and the General Plan of the City of Redwood City" <br />attached hereto as Exhibit "A" are hereby adopted and incorporated herein by reference. <br /> <br /> Section 4. The "Findings, Facts in Support of Findings and Statement of <br />Overriding Considerations Regarding the Environmental Impact Report for the Electronic <br />Arts Headquarters Master Plan," attached as Exhibit "A" to Resolution 12819 entitled <br />"Resolution Approving the Technical Addendum to the Redwood Peninsula <br />Environmental Impact Report and Certifying the Redwood Peninsula Environmental <br />Impact and Technical Addendum as the Project Environmental Impact Report," are <br />incorporated herein by reference. <br /> <br /> Section 5. The Development Agreement entitled "Development Agreement <br />between Flatirons Funding, Limited Partnership and the City of Redwood City" a copy <br />of which is on file in the office of the City Clerk, and incorporated herein by reference as <br />though set forth in full, is hereby approved, and the City Manager is hereby authorized to <br />execute the agreement for and on behalf of the City of Redwood City. <br /> <br /> Section 6. The City Attorney is authorized and directed to prepare an <br />execution copy of the Development Agreement and to make any necessary technical <br />corrections or additions to the Development Agreement prior to its execution, including <br />without limiting the foregoing, the insertion of relevant dates, the insertion of resolution <br />and ordinance numbers, the insertion of document identification numbers, and correction <br />of typographical errors. <br /> <br /> Section 7. The City Clerk shall cause a copy of this ordinance and of the <br />Development Agreement to be recorded in the office of the Recorder of San Mateo <br />County within ten (10) days after the Effective Date of the Development Agreement (as <br />defined in the Development Agreement); provided, however, that this ordinance shall be <br />effective thirty (30) days after its adoption. <br /> <br />EADAORD2.DOC 2 <br /> <br /> <br />
