2. Vested Rights. The City agrees that the Revised <br />Development is consistent with the Specific Plan designation and <br />CG zoning for the Property, and that pursuant to the Vesting <br />Tentative Map and other entitlements, the Owners have a vested <br />right to proceed with development of the Revised Development. <br />The City further agrees to process expeditiously any and all <br />applications for Architectural Permits and building permits for <br />the Revised Development. <br /> <br /> 3. Traffic Mitiqation Measures. The Owners agree to the <br />following traffic mitigation measures: <br /> <br /> (1) To include the Revised Development in an area-wide <br />district of commercial and other non-residential properties duly <br />formed for the purpose of building facilities to mitigate the <br />impact of traffic in Redwood Shores. <br /> <br /> (2) To establish a Transportation System Management <br />Program for the purpose of reducing peak hour auto travel and <br />single occupant vehicle travel. <br /> <br /> (3) To join in the Redwood Shores Business Owners <br />Association upon the issuance of a certificate of occupancy for <br />the Revised Development for the purpose of advancing community- <br />wide traffic mitigation measures in Redwood Shores. <br /> <br /> 4. Landscaping Mitigation Measures. The Owners agree to <br />the following landscaping mitigation measures: <br /> <br /> (1) To review the plant list to determine that <br />proposed plant material is suitable for the soil and wind <br />conditions. <br /> <br /> (2) To upsize plantings at the southern frontage <br />visible from Governors Bay to 24" box specimen trees from 15 gal. <br />size. <br /> <br /> (3) To screen parking areas by using appropriate <br />berms/mounds and tree or shrub plantings. <br /> <br /> (4) To specify adequate soil amendments to help ensure <br />a good growing medium. <br /> <br /> 5. Pedestrian Safety Contribution. The Owners agree to <br />contribute the sum of $34,000 (the "Pedestrian Safety <br />Contribution") towards the cost of pedestrian safety facilities <br />related to the Revised Development as specified by the City (such <br />as an extension of the sidewalk along Redwood Shores Parkway <br />opposite the Sandpiper Elementary School, traffic signals, etc.; <br />collectively, the "Pedestrian Safety Facilities"). <br />Notwithstanding the foregoing, if the Revised Development as <br /> <br /> <br />
