ORDINANCE NO. 2141 ORDINANCE ADDING CHAPTER 18B TO THE CODE OF THE CITY OF REDWOOD CITY RELATING TO SEXUALLY ORIENTED BUSINESSES The Council of Redwood City does ordain as follows: SECTION 1. FINDINGS. This Council hereby finds and determines as follows: (a) This Council, in adopting this ordinance, takes legislative notice of the existence and content of the following studies concerning the adverse secondary effects of sexually oriented businesses in other cities: Garden Grove, California (1991); Tucson, Arizona (1990); Seattle, Washington (1989); Austin, Texas (1986); Oklahoma City, Oklahoma (1986); Indianapolis, Indiana (1984); Houston, Texas (1983); Beaumont, Texas (1982); Minneapolis, Minnesota (1980); Phoenix, Arizona (1979); Whittier, California (1978); Amarillo, Texas (1977); Cleveland, Ohio (1977); Los Angeles, California (1977). (vi) Any conduct prohibited by this chapter. <br /> <br /> (3) Failure to comply with any conditions of a Permit or conditions pertaining to a <br /> prior suspension or revocation of a Permit. <br /> <br /> Sec. 18B.12. APPEAL OF DENIAL, SUSPENSION, OR REVOCATION. <br /> <br /> Denial by the Zoning Administrator of an application for a sexually oriented business Regulatory <br /> Permit or a sexually oriented business Performer Permit, or denial of a request for renewal of <br /> such a Permit, or any decision of the Heating Officer made pursuant to the provisions of Section <br /> 1BB.11 shall be appealable to the Council. Every such appeal shall be made in writing and filed <br /> with the City Clerk within seven (7) days of the determination from which appeal is being taken. <br /> The statement of appeal shall specify the grounds upon which the appeal is made and shall be <br /> accompanied by any supporting documentary material the appellant desires the Council to <br /> consider on the appeal. <br /> <br /> The written notice of appeal shall be accompanied by such non-refundable filing fee as may be <br /> established by resolution of the Council. <br /> <br />Upon receipt of the notice of an appeal, the City Clerk shall set the appeal for a hearing, which <br />shall be held within thirty (30) days of receipt of said notice and shall give written notice to the <br />appellant, the Zoning Administrator and the Police Chief of the date, time and place of said <br />hearing. The Clerk's notice to the appellant shall be given in writing personally, or by deposit <br />with the United States Postal Service, first-class postage prepaid, to the address specified in the <br />notice of appeal. <br /> <br />Upon conclusion of the hearing, the Council may affirm, reverse, or modify the decision or <br />determination of the Zoning Administrator or the Heating Officer, as the case may be, as the <br />Council deems just and equitable. The decision of the Council shall be final. <br /> <br /> ARTICLE III. FACILITIES AND EMPLOYEE <br /> <br />Sec. 18B.13. REQUIREMENTS. Sexually oriented businesses and sexually oriented <br />performances shall comply with the following requirements corresponding to such businesses or <br />activities: <br /> <br />(a) Maximum occupancy load, fire exits, aisles and fire suppression equipment shall be <br /> regulated, designed and provided in accordance with the Fire Department and building <br /> regulations and standards adopted by the City. <br /> <br />(b) No sexually oriented business shall be operated in any manner that permits the <br /> observation of any material or activities depicting, describing or relating to Specified <br /> Sexual Activities or Specified Anatomical Areas from any public right-of-way or from <br /> <br />AdOrd-1 16 <br />f/sh/sh/RC//ComD~v <br />04122/98 <br />DES:rg <br /> <br /> <br />
