ORDINANCE NO. 2141 ORDINANCE ADDING CHAPTER 18B TO THE CODE OF THE CITY OF REDWOOD CITY RELATING TO SEXUALLY ORIENTED BUSINESSES The Council of Redwood City does ordain as follows: SECTION 1. FINDINGS. This Council hereby finds and determines as follows: (a) This Council, in adopting this ordinance, takes legislative notice of the existence and content of the following studies concerning the adverse secondary effects of sexually oriented businesses in other cities: Garden Grove, California (1991); Tucson, Arizona (1990); Seattle, Washington (1989); Austin, Texas (1986); Oklahoma City, Oklahoma (1986); Indianapolis, Indiana (1984); Houston, Texas (1983); Beaumont, Texas (1982); Minneapolis, Minnesota (1980); Phoenix, Arizona (1979); Whittier, California (1978); Amarillo, Texas (1977); Cleveland, Ohio (1977); Los Angeles, California (1977). order to reduce the opportunity for, and therefore the incidence of illegal conduct within <br /> sexually oriented businesses, and to facilitate the inspection of the interior of the premises <br /> thereof by law enforcement personnel. <br /> <br /> (r) In consideration of the findings set forth in subdivisions (e) - (q), above, concurrently <br /> herewith, this Council has adopted that certain ordinance entitled, "Ordinance Adding <br /> Chapter 27 to Ordinance No. 1130, the Redwood City Zoning Ordinance, Relating to <br /> Sexually Oriented Businesses." References herein to '~his ordinance" shall be deemed to <br /> apply to this ordinance, adding Chapter 18B to the Code of the City of Redwood City and <br /> to the aforesaid ordinance adding Article 27 to Ordinance No. 1130, as amended, or to both <br /> such ordinances, depending upon the context. <br /> <br /> SECTION 2. Chapter 18B is hereby added to the Code of the City of Redwood City to <br /> read as follows: <br /> <br /> "Chapter 18B. SEXUALLY ORIENTED BUSINESSES ARTICLE I. GENERAL PROVISIONS <br /> <br /> Sec. 18B. 1. LEGISLATIVE PURPOSE: <br /> <br />It is the purpose of this chapter to regulate sexually oriented businesses in order to promote the <br />health, safety, morals, and general welfare of the citizens of the City. The provisions of this <br />ordinance have neither the purpose nor effect of imposing a limitation or restriction on the content <br />of any communicative materials, including sexually oriented materials. Similarly, it is not the <br />intent nor effect of this ordinance to restrict or deny access by adults to sexually oriented materials <br />protected by the First Amendment of the United States Constitution, or to deny access by the <br />distributors and exhibitors of sexually oriented entertainment to their intended market. Neither is it <br />the intent nor effect of this ordinance to condone or legitimize the distribution of obscene material. <br /> <br />Sec. 18B.2. DEFINITIONS: <br /> <br />For the purpose of this chapter the following words and phrases shall have the meanings <br />respectively ascribed to them: <br /> <br /> (a) Applicant. A person who is required to file an application for a permit under this chapter, <br /> including an individual owner, managing partner, officer of a corporation, or any other <br /> operator, manager, employee, or agent of a sexually oriented business. <br /> <br />(b) Bar. Any commercial establishment licensed by the State Department of Alcoholic <br /> Beverage Control to serve any alcoholic beverages on the premises. <br /> <br />(c) Distinguished or characterized by an emphasis upon. The term "distinguished or <br /> characterized by an emphasis upon" shall mean and refer to the dominant or essential theme <br /> of the object described by such phrase.
