ORDINANCE NO. 2141 ORDINANCE ADDING CHAPTER 18B TO THE CODE OF THE CITY OF REDWOOD CITY RELATING TO SEXUALLY ORIENTED BUSINESSES The Council of Redwood City does ordain as follows: SECTION 1. FINDINGS. This Council hereby finds and determines as follows: (a) This Council, in adopting this ordinance, takes legislative notice of the existence and content of the following studies concerning the adverse secondary effects of sexually oriented businesses in other cities: Garden Grove, California (1991); Tucson, Arizona (1990); Seattle, Washington (1989); Austin, Texas (1986); Oklahoma City, Oklahoma (1986); Indianapolis, Indiana (1984); Houston, Texas (1983); Beaumont, Texas (1982); Minneapolis, Minnesota (1980); Phoenix, Arizona (1979); Whittier, California (1978); Amarillo, Texas (1977); Cleveland, Ohio (1977); Los Angeles, California (1977). Sec. 18B.3. PERMITS REQUIRED: <br /> <br /> (a) It shall be unlawful for any person to engage in, conduct or carry on, or to permit to be <br /> engaged in, conducted or carried on, in or upon any premises in the City, the operation of a <br /> sexually oriented business unless said person first obtains and continues to maintain in full <br /> force and effect a sexually oriented business Regulatory Permit as herein required. <br /> <br /> (b) It shall be unlawful for any person to engage in or participate in any live performance in a <br /> semi-nude state, exhibiting specified anatomical areas or involving specified sexual <br /> activities in a sexually oriented business unless said person first obtains and continues in <br /> full force and effect a sexually oriented business Performer Permit from the City as herein <br /> required. <br /> <br /> ARTICLE II. APPLICATION AND PERMITS <br /> <br /> Sec. 18B.4. SEXUALLY ORIENTED BUSINESS REGULATORY PERMIT REQUIRED: <br /> <br /> Every person who proposes to maintain, operate or conduct a sexually oriented business in <br /> the City shall file an application for a sexually oriented business regulatory permit with the <br /> Zoning Administrator upon a form provided by said Administrator, and shall pay a <br /> nonrefxmdable filing fee in an mount established by resolution adopted by the Council. <br /> The sexually oriented business regulatory permit required under this article shall be in <br /> addition to all other permits required by the City. <br /> <br />Sec. 18B.5. APPLICATIONS: <br /> <br />(a) Sexually oriented business Regulatory Permit applications shall include the following <br /> information: <br /> <br /> (1) If the applicant is an individual, the individual shall state his or her legal name, <br /> including any aliases, address, and submit satisfactory written proof that he or she is <br /> eighteen (18) years of age or older. <br /> <br /> (2) If the applicant is a partnership, the parmers shall state the partnership's complete <br /> name, address, the names of all partners, whether the partnership is general or <br /> limited, and attach a copy of the parmership agreement. <br /> <br /> (3) If the applicant is a corporation, the corporation shall provide its complete name, the <br /> date of its incorporation, evidence that the corporation is in good standing under the <br /> laws of California, the names and capacity of all officers and directors, the name of <br /> the registered corporate agent and the address of the registered office for service of <br /> process. <br /> <br />AdOrd-1 9 <br />f/sh/sh/RC//ComD~v <br />04/22/98 <br />DES:rg <br /> <br /> <br />
