ORDINANCE NO. 2152 ORDINANCE ADDING ARTICLE HEADING I FOR SECTIONS 15 15.7 AND REPEALING SECTION 15.8 OF, AND ADDING ARTICLES II, III, AND IV TO, CHAPTER 15 OF THE CODE OF CITY OF REDWOOD CITY RELATING TO LOCAL SMOKING REGULATIONS, ENFORCEMENT OF STATEWlDE SMOKING PROHIBITIONS, TOBACCO RETAIL PERMITS AND PENALTIES FOR VIOLATIONS OF THE PROVISIONS OF SAID CHAPTER, RESPECTIVELY. THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: Section 1. Findings. This Council hereby finds and declares that: (a) Sections 15.1 through 15.7 of the Code of the City of Redwood City, as added by Ordinance No. 1969, adopted June 20, 1988, established regulations regarding smoking in the City of Redwood City (the "Local Regulations

(h) Within the last three years in San Mateo County, only 19 persons have <br /> been cited for violation of said section. <br /> <br /> (i) More than 3 million minors consume more than 947 million packs of <br /> cigarettes annually in the United States, and over 29 million packs of cigarettes are <br /> sold to California children; <br /> <br /> (j) Studies indicate that nearly 90% of all tobacco users commence smoking <br /> below the age of 18, and that the average child smoker commenced using tobacco <br /> products at age 13 and acquired a daily smoking habit by the age of 14-1/2; <br /> <br /> (k) This City has a substantial interest in reducing illegal sales of tobacco <br /> products to minors; <br /> <br /> (I) A requirement that tobacco retailers sell tobacco products pursuant to a <br /> permit will not unduly burden legitimate business activities of tobacco retailers; <br /> <br /> (m) It is the intent of this Council by adding Article Ill to Chapter 15 of the <br /> Code of the City of Redwood City pursuant to this Ordinance to prevent the unlawful <br /> sale or distribution of tobacco products to minors and the unlawful purchase or <br /> possession of tobacco products by minors; <br /> <br /> (n) It is the further intent of this Council, by adding Article IV to Chapter 15 of <br /> the Code of the City of Redwood City pursuant to this Ordinance that violations for the <br /> provisions of said Chapter shall be deemed infractions. <br /> <br /> Section 2. Article heading I of Chapter 15, encompassing Sections 15.1-15.7, <br /> inclusive, is hereby added to the Code of the City of Redwood City to read as follows: <br /> <br /> "Article I. <br /> Local Smoking Regulations" <br /> <br /> Section 3. Section 15.8 of the Code of the City of Redwood City is hereby <br /> repealed. <br /> <br /> Section 4.
