Section 15.22. Applications. Application for a tobacco retail permit shall be <br />submitted in the name of the entity or person proposing to conduct retail tobacco <br />sales on the business premises and shall be signed by such person or an authorized <br />agent thereof. All applications shall be submitted on a form supplied by the Health <br />Officer and shall contain the following information: <br /> <br /> 1. The name(s), address, and telephone number of the applicant. <br /> <br /> 2. The business name, address and telephone number of each <br />establishment where tobacco is offered for retail sale; and <br /> <br /> 3. Such other information as the Health Officer deems reasonable and <br />necessary for the implementation of this Article. <br /> <br />Section 15.23. Issuance. Upon receipt of an application for a tobacco retail permit, <br />the Health Officer shall issue a permit which must be prominently displayed at the <br />location where tobacco retail sales are conducted. <br /> <br />Section 15.24. Fee. The fee for a tobacco retail permit shall not exceed the cost of <br />processing the permit and shall be contained in the City's Fee Schedule. <br /> <br />Section 15.25. Nontransferable. A tobacco retail permit is nontransferable to a new <br />person or entity or to a new location. In the event a permittee proposes to transfer a <br />permit to another person or entity or to conduct retail tobacco sales at a different <br />location, a new application for a tobacco retail permit shall be submitted for the <br />proposed transferee or location. A permit shall be issued for the new address or <br />person or entity upon completion of the application and payment of the processing <br />fee. The new permit shall retain the same expiration date as the prior permit. <br /> <br /> Section 15.26. Suspension and Revocation. <br /> <br /> (a) Grounds. A tobacco retail permit may be suspended or revoked as set <br /> forth below in subdivision (b), by the Health Officer upon a finding, after notice and <br /> opportunity to be heard, that: <br /> <br /> (1) The permittee or his or her employee has sold, given, or in any way <br /> furnished to a person who is under the age of 18 years any tobacco, cigarette, or <br /> cigarette papers, or any other preparation of tobacco or any other instrument or <br /> paraphernalia that is designed for the smoking or ingestion of tobacco or products <br /> prepared from tobacco; and <br /> <br /> (2) The evidence used to make the finding in (1) was obtained in compliance <br /> with Business and Professions Code section 22952 and any regulation promulgated <br /> thereunder. <br /> <br />Ord-040 4 <br />flshlshlRC/Council <br />DES:rr;rg ? ]. 52 <br />08/19/98; 09122198R:og128198R <br /> <br /> <br />
