8/23/99 <br /> ORIGINAL <br /> <br /> ORDINANCE NO. 2180 <br /> <br /> ORDINANCE OF THE COUNCIL OF THE CITY OF REDWOOD CITY <br /> AUTHORIZING THE LEVY OF A SPECIAL TAX WITHIN REDWOOD <br /> SHORES COMMUNITY FACILITIES DISTRICT NO. 99-1 (SHORES <br /> TRANSPORTATION IMPROVEMENT PROJECT) OF THE CITY OF <br /> REDWOOD CITY <br /> <br /> WHEREAS, on March 22, 1999, the Council of the City of Redwood City (the "Council") <br />adopted its Resolution No. 13590 stating its intention to form Redwood Shores Community <br />Facilities District No. 99-1 (Shores Transportation Improvement Project) of the City of Redwood <br />City (the "District") pursuant to the Mello-Roos Community Facilities Act of 1982, as amended <br />(constituting Section 53311 et seq. of the Government Code) (the "Act"), for the purpose of <br />financing (1)the construction, purchase, modification, expansion, improvement or rehabilitation of <br />sanitary sewers, streets, storm drainage facilities, utilities, parks, landscaping, and other <br />infrastructure improvements and relocations, including traffic signalization and improvements to <br />street intersections and freeway interchanges, for the following projects, including all furnishings, <br />equipment, and supplies related thereto (collectively, the "Facilities"): (a) the Marine Parkway <br />intersection at or near Oracle West/Shoreway Road; (b) the Marine Parkway intersection at or near <br />Twin Dolphin Parkway; (c)the Marine Parkway intersection at or near Bridge Parkway; (d)the <br />Redwood Shores Parkway intersection at or near Bridge Parkway; (e)the Ralston Avenue <br />intersection at or near Hiller Street; fi)the northbound U.S. 101 on-ramp at the Marine <br />Parkway/Ralston Avenue interchange; (g)the HOV bypass lanes at the northbound U.S. 101 on- <br />ramp at the Ralston Avenue interchange; and (h)the reconfiguration of the U.S. 101/Marine <br />Parkway/Ralston Avenue interchange to a partial cloverleaf design; all as such improvements are <br />more fully described in the "Shores Transportation Improvement District (STID) Final Report - <br />Phase II" report dated as of April 10, 1998 and supplemented in the "Shores Transportation <br />Improvement District (STID) Supplement to Final Report" supplement dated as of June 10, 1998 <br />prepared by Brian Kangas Foulk, and (2) incidental expenses to be incurred, including (a) the cost of <br />engineering, planning and designing the Facilities; and (b) all costs associated with the creation of <br />the District, the issuance of the bonds, the determination of the amount of special taxes to be levied, <br />costs otherwise incurred in order to carry out the authorized purposes of the District and <br />administering the District (collectively, the "Incidental Expenses"), all as more fully described in <br />Resolution No. 13590; and <br /> <br /> WHEREAS, notice was published and mailed as required by law relative to the intention of <br />the Council to form the District, to levy a special tax therein, and to incur bonded indebtedness for <br />the purpose of financing the Facilities and the Incidental Expenses; and <br /> <br /> WHEREAS, on April 26, 1999, the Council held a noticed public hearing as required by law <br />relative to the proposed formation of the District, the levy of the special tax therein, and the issuance <br />of bonded indebtedness by the District; and <br /> <br /> WHEREAS, at the public hearing all persons desiring to be heard on all matters pertaining to <br />the formation of the District, the levy of the special tax, and the issuance of bonded indebtedness <br />were heard and a full and fair hearing was held; and <br /> <br />17385.2~22931.0003 <br /> <br /> <br />
