"Section 40.11. Appeals. Any interested party may <br />appeal any decision by the Commission pursuant to Section <br />40.10 by filing a notice of appeal with the City Council not <br />later than ten days after the Commission's decision. Such <br />notice shall be accompanied by a fee of $100. The City <br />Council shall schedule a public hearing to be held no later <br />than 90 days after the notice of appeal is filed and shall <br />render its decision within 30 days of said hearing date. <br />At the public hearing, the Council shall provide a reasonable <br />opportunity for all interested parties to express their <br />opinions. The City Clerk shall notify by mail all applicants <br />for the appeal and the owners and occupants of all <br />properties affected by said appeal, of the time and date <br />set for such public hearing. The aforementioned people <br />shall also be notified by mail of the Council's decision <br />on the appeal. <br />"Section 40.12. Ordinary Maintenance and Repair. Nothing <br />in this chapter shall be construed to prevent any and all <br />reasonable uses of any property or properties covered by <br />this chapter as are not in conflict with the purposes of <br />this chapter, including the ordinary maintenance or repair <br />of said property that does not involve a change in design, <br />material or external appearance thereof. <br />"Section 40.13. Unsafe or Dangerous Conditions. Nothing <br />in this chapter shall be construed to prevent any measures <br />of construction, alteration or demolition necessary to <br />correct the unsafe or dangerous condition of any structure, <br />or feature or part thereof, covered by this chapter, where <br />such condition has been declared unsafe or dangerous by <br />the Building Official or the Fire Marshal, and where the <br />proposed measures have been declared necessary by such <br />officials to correct such condition; provided, however, <br />-9- <br />
