Description
ORiGINAL ORDINANCE REPEALING CHAPTER 33 OF, AND ADDING CHAPTER 33 TO, THE CODE OF THE CITY OF REDWOOD CITY RELATING TO TAXICAB REGULATIONS THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Chapter 33 of the Code of the City of Redwood City is hereby repealed. SECTION 2. Chapter 33 is hereby added to the Code of the City of Redwood City to read as follows: "CHAPTER 33. TAXICABS "ARTICLE I. DEFINITIONS

<br /> SWC:rb 9/12/83 <br /> . ~: rb 9/19/83R <br /> SWC:rb 10/06/83R <br /> SWC:rb 10/10/83R <br /> Vehicles record includes four ( 4) or more moving violations <br /> within the preceding twelve-month period or if the Chief of <br /> Police determines that the driver is a danger to the public <br /> safety. <br /> "Section 33.41. Whenever the Chief of Police intends <br /> to deny an application or revoke a permit for driving a taxicab, <br /> he shall give the applicant or permit holder written notice of <br /> intent to deny such application or to revoke such driver's <br /> permit. The notice shall set forth the grounds upon which such <br /> denial or revocation is contemplated, and shall inform such <br /> applicant or permit holder that he or she has ten (10 ) days from <br /> the date of such notice to file a written request for a hearing. <br /> The application may be denied or the permit revoked if a request <br /> for a hearing is not received within the ten-day period. <br /> "If the applicant or permit holder files a timely request <br /> for hearing, the Chief of Police shall set a time and place for <br /> such hearing, and shall consider all relevant evidence and <br /> testimony prior to making a decision thereon. The decision of <br /> the Chief of Police to revoke a permit or deny an application is <br /> final and no appeal may be made therefrom. <br /> "Section 33.42. No duty described in this chapter <br /> shall be considered a mandatory duty for purposes of the <br /> California Torts Claim Act, Government Code Section 815 et. seq. <br /> Specifically, the failure of the city to inspect any taxicab or <br /> pursuant to this chapter or the negligent inspection of any <br /> 18 <br /> 18~1 <br /> -..--.- <br />
