1883 --------- - - NOV 7 1983 AN ORDINANCE AMENDING SECTIONS 5.1, 5.1.1, 5.2, 5.17, 5.20, 5.21, 5.22.5, 5.23, 5.63.1, 5.65 AND 5.91 OF, ADDING SECTION 5.24, DIVISION 4 (COMMENCING WITH SECTION 5.25) OF ARTICLE II AND SECTION 5.61 TO, REPEALING SECTIONS 5.6, 5.13, 5.14, 5.16, 5.22.1, 5.24, 5.24.1, 5.24.2, 5.24.3, DIVISION 3 (COMMENCING WITH SECTION 5.31) OF ARTICLE III, SECTIONS 5.61 AND 5.64 OF, AND RENUMBERING SECTIONS 5.25 AND 5.26 OF, THE CODE OF THE CITY OF REDWOOD CITY REGARDING PERMITS FOR DANGEROUS AND VICIOUS ANIMALS THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Section 5.1 of the Code of the City of Redwood City is hereby amended to read as follows: "Section 5.1. (a) Animal Control Shelter: Those facilities provided for the impounding of animals

<br /> ~GM:rb 7/14/83 <br /> GM: rb 10/19/83R <br /> CGM:rb 10/24/83R <br />Animal Control Services may be represented by counsel, <br />may present oral and written evidence, and may <br />cross-examine witnesses. Strict rules of evidence <br />need not apply. Any relevant evidence may be admitted <br />if it is the type of evidence on which responsible <br />persons are accustomed to rely in the conduct of <br />serious affairs. The decision of the Health Officer <br />or his designee shall be supported by the weight of <br />the evidence and shall be final. The petitioner shall <br />be given written notice of the decision within fifteen <br />(15) days of the hearing. The Health Officer or his <br />designee may decide that the owner of the animal shall <br />lose all rights of ownership and control of the <br />animal and may order that the animal be destroyed if <br />the animal has bitten or injured a person. Such <br />Health Officer or his designee may declare an animal <br />to be vicious or dangerous. He may require that the <br />owner before the animal is released to his custody to <br />obtain a permit and sign an agreement which contains <br />conditions, including, but not limited to, the <br />following: <br />" (1) To keep the animal confined on his premises in an <br />enclosure approved by the Department of Animal Control <br />Services; <br />" (2) To keep the animal securely muzzled leashed and <br />under the control of a person eighteen (18) years of <br />age or older, and who is physically capable of <br />restraining the animal when the animal is off his <br />property; <br /> 8 <br /> .- --þ....- <br />
