CGM:djg-c 12/23/83R DES:rb 1/23/84R N Q. 1 8 9 1 APR 1984 --------- AN ORDINANCE REPEALING ARTICLE III (COMMENCING WITH §11.70) OF, AND ADDING ARTICLE III (COMMENCING WITH §11.70) TO, CHAPTER 11 OF THE CODE OF THE CITY OF REDWOOD CITY RELATING TO COMMUNITY ANTENNA TELEVISION SYSTEM REGULATIONS THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. Article III (commencing with §11.70) of Chapter 11 of the Code of the City of Redwood City is hereby repealed. SECTION 2. Article III (commencing with §11.70) is hereby added to Chapter 11 of the Code of the City of Redwood City to read as follows

<br /> C'GM:mf 01/26/83 <br /> ¡M:mf 02/14/83R <br /> CGM:djg-c 10/18/83R <br /> CGM:rb 11/01/83R <br /> CG~1: dj g-c 12/23/83R <br /> DES:rb 1/23/84R <br />(a) the Grantee has defaulted, or is in default in the <br /> performance of any of its material obligations under <br /> a franchise or pursuant to any other agreement between <br /> the City and the Grantee related to the CATV system; <br />(b) the Grantee's quality of service and response to <br /> subscriber complaints have demonstrated a continuing, <br /> willful pattern of inadequacy, which has not been <br /> corrected by the Grantee after due notice by City; <br />(c) the Grantee has failed to provide or maintain in <br /> full force and effect the liability and indemnification <br /> coverages or the construction and performance bond, or <br /> security fund as specified in the franchise; <br />(d) the Grantee has frequently violated any orders or <br /> rulings of any regulatory body having jurisdiction over <br /> the Grantee relative to its franchise unless such orders <br /> or rulings are being contested by the Grantee in a court <br /> of competent jurisdiction; <br />(e) the Grantee has attempted to evade any of the provisions <br /> of its franchise or has practiced any fraud or deceit <br /> upon the City; <br />(f) the Grantee has became insolvent, unable or unwilling to <br /> pay its debts, or is adjudged a bankrupt. <br /> "Section 11. 7 4 . Any Grantee granted a franchise under this <br />article shall pay to the City, during the life of such franchise, <br />and at the times hereinafter specified, not more than five (5) <br />per cent of the gross annual revenues derived from the use of the <br />franchise, which percentage shall be set forth in the ordinance <br />awarding the franchise, and such payment by the Grantee to the <br />City shall be in addition to any occupation tax, license tax or <br />similar levy or fee imposed by the City. <br /> "Section 11.75.
