<br /> CGH:djg-c 1/28/83 <br /> CGM: g-c 9/14/83R <br /> CGM:ùJg-c 9/20/83R <br /> CGM:djg-c lO/lO/83R <br /> CGM:rb 11/01/83R <br /> CGM:rb 12/27/83R <br /> CGM:djg-c 01/23/84R <br /> DES:rb 01/23/84R <br />or adjudication as a bankrupt. <br />Failure of Grantee to perform any of its obligations agreed to <br />be performed by Grantee pursuant to this franchise due to any Act <br />of God or to an act of a person, firm, company, corporation or <br />partnership not under control of Grantee shall not be considered <br />to be a franchise violation if after the Act of God or the act of <br />such third party ceases to have an effect on such obligations, <br />Grantee performs such obligation within a reasonable time. In the <br />event that any court of competent jurisdiction, the FCC or any <br />state regulatory body, by rules, decisions, or other action, <br />determines that any material provision of the franchise documents, <br />including this franchise, is invalid or unenforceable, the Grantor <br />and Grantee shall renegotiate such provision. <br />SECTION 11. PROCEDURE. If the Grantor makes a determination <br />that Grantee is in violation of any provision of this franchise, <br />any rule or regulation promulgated pursuant thereto, or any <br />applicable Federal, State, or local law, the Grantor shall make <br />a written demand to the Grantee that it remedy such violation. <br />If the violation is not remedied to the satisfaction of the <br />Grantor within thirty (30) days following such demand, the Grantor <br />shall determine whether or not such violation by the Grantee was <br />excusable or inexcusable, in accordance with the following <br />procedure: <br />(a) Grantor shall provide Grantee with a notice that <br />Grantee has an opportunity to respond to the allegation that <br /> 17 <br /> ,'-,"^ "-r-.""'.'- <br />
