Each CATV subscriber shall receive a minimum signal <br />strength of two thousand (2,000) microvolts as measured at the <br />antenna terminals of the television set. <br /> " (i) In the event the Federal Communications Commission <br />establishes jurisdiction over performance and maintenance <br />standards of the Grantee, then the authority of the City Council <br />to establish and enforce such standards shall cease only to the <br />extent it is so preempted. <br /> "Section 11.85. (a) All matters herein provided to be <br />filed with the City shall be filed with the City Clerk. <br /> " (b) If the Grantee should fail to operate its system for a <br />period of nine (9 ) months from the date its service begins, the <br />subscribers who have paid installation charges shall be entitled <br />to a refund of the installation charges less one-ninth (1/9th) of <br />each charge for each month elapsing from the time service was <br />first started and remained available to each such subscriber. If <br />the Grantee shall fail to repair a subscriber's CATV facilities <br />within three (3 ) working days from receipt of a complaint from a <br />subscriber as to the services provided to such subscriber's <br />address, the Grantee shall provide a credit to such subscriber <br />for the entire time such facilities have not been repaired by the <br />Grantee. If the Grantee is prevented from performing its <br />obligations due to an act beyond the control of the Grantee, the <br />above provisions shall not be applicable if the Grantee performs <br /> 13 <br /> ......-.- <br />
