FORCE MAJEURE. Grantee shall not be deemed in <br /> default of any provision of this franchise or subjected to any <br /> penalty or required to perform any remedy accruing to Grantor <br /> hereunder when timely performance or timely compliance l.S <br /> prevented by Acts of God, civil emergencies, or national <br /> disasters, or acts of third parties which are reasonably beyond <br /> Grantee's ability to control; however, Grantee is obligated to <br /> perform or comply within a reasonable amount of time after the <br /> event or action which precluded it from timely performing or <br /> acting no longer exists. The term IIForce Majeure" as used in <br /> this franchise is defined by the foregoing. <br /> SECTION 15. OPERATIVE DATE. Grantee shall execute the <br /> written acceptance clause of this franchise within thirty (30) <br /> days after the adoption of this Ordinance.
