9.A. - Page 2 of 7 <br />When Does the Flavored Tobacco Ordinance Go Into Effect? <br />The ordinance took effect on June 19, 2018, and enforcement began on January 1, <br />2019. Tobacco retailers who continue to sell flavored tobacco products place <br />themselves at risk of receiving a fine and/or having their tobacco retailer license <br />suspended. <br />What is Considered a Flavored Tobacco Product? <br />A flavored tobacco product is any nicotine or tobacco product, including but not limited <br />to smokeless/chew, cigarettes, cigars, cigarillos, vape liquid (used in e -cigarettes), and <br />hookah tobacco, that contains an aroma and/or flavor, such as menthol, mint, fruit, <br />spice, sweet, or a food or drink product (i.e. Pancake or Cherry Slush.) <br />Councilmember Masur recommended that a Redwood City ordinance exempt hookah bars. <br />On October 23, 2019, the Redwood City School District passed a resolution requesting that the City of <br />Redwood City develop an ordinance to restrict the sale of tobacco products, including: <br />• Prohibit the sale of flavored tobacco products; <br />• Prohibit the sale of e -cigarettes and electronic vaping devices; <br />• Prohibit the sale of tobacco products in pharmacies; <br />• Set a minimum price and minimum pack size for sale; <br />• Restrict the marketing, product placement, and promotional materials in and from retailers; and <br />• Reduce the concentration and density of tobacco stores, particularly near schools and other <br />youth sensitive areas. <br />The Redwood City School District resolution is provided in Attachment A. Additionally, on September 24, <br />2019, the City Council received a letter (Attachment B) from Sequoia Union High School District <br />Superintendent Mary Streshly urging the City Council to take similar actions. <br />ANALYSIS <br />If directed by the City Council, staff will place this topic on a future City Council agenda and provide an <br />analysis of a potential ordinance and the resources required to implement it. <br />FISCAL IMPACT <br />No analysis has been completed to date so the impact is unknown. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />City of Redwood City 1017 Middlefield Road, Redwood City, CA. 94063 Tel: 650-780-7000 www.redwoodcity.ore <br />209 <br />
