a) Subrecipient will not discriminate against any employee or applicant for <br />employment on the basis of religion and will not limit employment or give preference in <br />employment to persons on the basis of religion; and <br />b) Subrecipient will provide no religious instruction or counseling, conduct no <br />religious worship or services, engage in no religious proselytizing, and exert no other <br />religious influence related to the Project. <br />24. COMPLIANCE WITH CALIFORNIA LABOR LAWS AND FEDERAL <br />REQUIREMENTS. The Subrecipient agrees to comply with the requirements of the <br />Secretary of Labor in accordance with the Davis -Bacon Act, as amended, the provisions <br />of the Contract Work Hours and Safety Standards Act (40 U.S.C. 3701 et seq.) and all <br />other applicable federal, state and local laws and regulations pertaining to labor <br />standards insofar as those acts apply to the performance of this Agreement. <br />Subrecipient agrees to comply with the Copeland Anti -Kickback Act (18 U.S.C. 874, 40 <br />U.S.C. 3145) and its implementing regulations of the U.S. Department of Labor at 29 <br />CFR Part 3. <br />Subrecipient agrees that, pursuant to 42 U.S.C. 5310, all laborers and mechanics <br />employed by contractors or subcontractors in the performance of construction work <br />financed in whole or in part with assistance received from the Community Development <br />Block Grant funds will be paid wages at rates not less than those prevailing on similar <br />construction in the locality as determined by the Secretary of Labor in accordance with <br />the Davis -Bacon Act, as amended (40 U.S.C. 3141-3148); provided that this section will <br />apply to the rehabilitation of residential property only if such property contains not less <br />than 8 units. <br />A paragraph will be incorporated in every agreement between Subrecipient and <br />third parties in connection to the Project stating that the third party must comply with <br />California Labor Laws and applicable federal requirements. Subrecipient will maintain <br />documentation that demonstrates compliance with hour and wage requirements of this <br />REV: 09-09-19 DZ <br />
