T. <br />. . .,. . .. <br />. . <br />.. . <br />. . . . <br />.. . <br /> <br /> <br />December 10, 2007 <br /> <br />SUBJECT <br />Peninsula Park - Amendment to Agreement for Professional Environmental Assessment <br />Services <br /> <br />RECOMMENDATION <br />Approve by motion Amendment #3 to the Agreement with Wagstaff and Associates for <br />professional environmental review services for the Peninsula Park project. <br /> <br />BACKGROUND <br />In Spring 2006, R.C Peninsula Park, LLC submitted an application for a mixed use <br />development containing 796 multi-family residential units; 10,000 square feet of <br />neighborhood serving retail space; a 200-room hotel; public park areas totaling 2.79 <br />acres; and 5.38 acres of marina and canals. The project review included the preparation <br />of an Addendum to the 2003 Environmental Impact Report (EIR) for the Marina Shores <br />Village Project. The Marina Shores Village approval was repealed through a local voter <br />referendum in November 2004; however, the certification of the Final EIR was not part <br />of the referendum. The City has determined that an Addendum to the previously <br />certified EIR is the appropriate environmental review document for the Peninsula Park <br />project, pursuant to CEQA Guidelines. The Addendum describes the changes and <br />additions to the previously certified EIR and identifies mitigation measures that have <br />been removed as a result of the reduced project scope, mitigation measures that remain <br />applicable, and the impacts that continue to be significant and unavoidable. <br /> <br />During the preparation of the Addendu"., staff made the determination that the 2002 <br />traffic counts used in the certified ErR no 10nger represented existing conditions for the <br />environmental analysis. As a result, new traffic counts were conducted in September <br />2007. Wagstaff and Associates, environmental consultant to the City for the Peninsula <br />Park project, along with Fehr and Peers (traffic engineers), have prepared a scope of <br />work to provide the additional traffic counts and associated analysis, complete text <br />revisions to the Addendum, provide response to comments, etc. This proposal to <br />conduct additional work for a total of $37,003.90 will be the third amendment to the <br />original contract if it is approved. <br /> <br />A brief history of this contract and associated amendments is summarized below: <br />. October 2006: Original contract for $91,455. <br />. May 2007: Amendment #1 for $6,500 to update the traffic analysis based on the <br />2002 traffic counts in the Marina Shores Village EIR. This amendment was <br />approved by the City Manager because it fell within the 10% contingency <br />allowance of the original agreement. <br />. November 2007: Amendment #2 for $2,400 to revise text regarding wastewater <br />and general preparation of the final document. This amendment was approved <br />
