<br />. i 6.28 <br />Page 5 <br /> <br />A. Employee shall accrue 6.154 hours of vacation leave per <br />pay period. This yields 160 hours of vacation per year. At the <br />commencement of the City Clerk's seventh year of service <br />with the City, vacation will be accrued at 6.923 hours per pay <br />period. This yields 180 hours of vacation per year. At the <br />commencement of the.City Clerk's tenth year of service with <br />the City, vacation will be accrued at 7.692 hours per pay <br />period. This yields 200 hours of vacation per year. <br /> <br />B. Employee shall be credited with eighty (80) hours of sick <br />leave immediately following commencement of her <br />employment. Thereafter City Clerk shall accrue sick leave at <br />the rate of eight (8) hours per month. <br /> <br />C. In the event that Employee is required to wait a period of <br />time ("wait period") before she is eligible to be covered under <br />the City's health care plan, and she is required to expend <br />funds to continue the medical health plan she currently <br />enjoys as an employee of the City of Menlo Park during that <br />wait period, the City shall reimburse Employee for those <br />expenditures. <br /> <br />4. <br /> <br />A. <br /> <br />Employee is an at-will employee of the City and nothing in this <br />document shall prevent, limit or otherwise interfere with the right of <br />the City Council to terminate the services of Employee at any time, <br />subject to the provisions of Section 5. <br /> <br />B. Nothing in this document shall prevent, limit or otherwise interfere <br />with Employee's right to resign at any time from her position with <br />City, subject to the provisions of Section 5. <br /> <br />5. <br /> <br />A. <br /> <br />At any time, Employee may resign from her employment as City <br />Clerk upon 30 days advance written notice to the City Council. <br /> <br />B. At any time and notwithstanding the above to the contrary, the City <br />Council may, without cause, terminate Employee's employment as <br />City Clerk upon thirty (30) days advance, written notice to the <br />Employee; provided that: <br /> <br />1. <br /> <br />If Employee is terminated without cause, she shall be <br />entitled to be paid three (3) months of the base salary <br />("severance pay") at the rate she is earning upon the <br />effective date of her termination, payable over the <br />immediately following three (3) month period at the <br />same time other management employees are paid <br /> <br />Atty/Agr/2007.102 <br />111907 <br /> <br />2 <br />
