7B <br /> Page 13 <br /> decision of the fire code official to the Council within ten {10) days from the date <br /> of the decision of the fire code off►cial. The decision of the Counci! on such <br /> appeal shall be final. <br /> Section 12.30. New Materials, Processes, Occupancies Requiring Permits. <br /> The City Manager, Fire Chief and the fire code official shall act as a <br /> committee #o determine and specify, after giving affected persons an opportunity <br /> to be heard, any new materials, processes or occupancies, which shall require <br /> permits, in addition to those now enumerated in the Fire Code. <br /> Section 12.31. Violations; Penal#ies. <br /> A. Any person, firm, corporation or entity whether as principal, agent, employee <br /> or otherwise, who shall vio{ate or cause the violation of any of the Fire Cade <br /> adopted by Section 12.7 and as amended by this Article, or who shall fail to <br /> comply wi#h any order, license, or perrnit made or issued thereunder, or who <br /> shali buifd any structure or improvement in violation o# this Code or any <br /> detailed statement of specifications or plans submitted and app�oved <br /> thereunder, for each and every such violation and noncompliance, <br /> respectively, shall be guilty of an infraction and, sh�ll be punishable by: <br /> 1. A fine not exceed€ng one hundred dollars ($1 Q0.00) for a first violation; <br /> and <br /> 2. A fine not exceeding five hundred doflars ($5DO.OQ) for a second violation <br /> of the same provision within one year from the date of the first violation; <br /> and <br /> 3. A fine not exceeding one thousand dollars ($1,000.00) for each additional <br /> violation of the same provision within one year from the date of the first <br /> violation. <br /> The imposition af any one penalty for any vio(ation shall not excuse the <br /> ��iolation or psrmi# to continue. Each �nd e4�Ar�r d�y a ��iolation shall contirue <br /> shall be deemed to be a separate violation. <br /> B. Use of the enforcement procedures of this section will be at the sole <br /> discretion of the Fire Chief, the fire code official, or their designees and will <br /> no# limit or preclude the use of any other enforcement measures pursuant to <br /> this Code, State or Federal law. <br /> C. The Fire Chief or his authorized representatives shall enforce the provisions <br /> of the Fire Code adopted by Section 12.7 and as amended by this Article and <br /> ail orders, licenses, certificates, permits and plans and specifications issued <br /> or approved thereunder and shall �ave the authority to issue citations for <br /> violations thereof." <br /> Atty/Ord/Ord.293 11 <br /> 120407 <br />
