<br />12/17/2007 <br /> <br />WHEREAS, in connection with the Project the City intends to act on the following: (1) a <br />Zoning Map Amendment to Planned Community District (P District) for the area of the Peninsula <br />Park Precise Plan; (2) approval of the Peninsula Park Precise Plan, pursuant to Article 52 of the <br />Redwood City Zoning Ordinance; and (3) a Development Agreement; and <br /> <br />WHEREAS, CEQA requires that, in connection with the approval of a project for which <br />an FEIR has been prepared which identifies one or more significant environmental effects, the <br />decision-making agency make certain findings regarding those effects. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY, AS FOLLOWS: <br /> <br />1. This Council hereby finds and affirms that the Addendum to the 2003 MSV EIR <br />as well as the original 2003 MSV FEIR has been completed in compliance with CEQA; that the <br />City Council has reviewed and analyzed any other information in the record and has considered <br />the information contained therein, including the written and oral comments received at the public <br />hearings on the FEIR and the Project, prior to acting upon or approving the Project; and that the <br />FEIR represents the independent judgment of the City of Redwood City; and <br /> <br />2. The Findings and recommendations set forth in Exhibit A, and incorporated <br />herein by reference, are made by this Council as the City's findings under the California <br />Environmental Quality Act ("CEQA") (Pub. Resources Code 9 21000 et sea.) and the CEQA <br />Guidelines (Cal. Code Regs., title 14, 915000 et sea.) relating to the Project. The Findings <br />provide the written analysis and conclusions of the Council regarding the Project's <br />environmental impacts, mitigation measures and alternatives to the Project. <br /> <br />3. The incorporated features of the Peninsula Park Precise Plan Project and other <br />modifications to the Initial Project do not create any potentially significant environmental impact <br />which was not associated with the Initial Project, or significantly increase any potentially <br />significant environmental impact associated with the Initial Project, but do reduce or eliminate a <br />number of potentially significant environmental impacts of the Initial Project, as described in <br />Exhibit A to this resolution. Inclusion of those features which are not part of the Precise Plan <br />would prevent the Project from achieving fundamental objectives, and would not be feasible, for <br />reasons described in Exhibit A to this resolution. Pursuant to Public Resources Code Section <br />21081 and CEQA Guidelines Sections 15091 et seq., the City Council adopts and makes the <br />following statement of overriding considerations regarding the remaining unavoidable impacts of <br />the Project and the anticipated economic, social and other benefits of the Project. <br /> <br />a. SiQnificant Unavoidable Impacts. <br /> <br />With respect to the foregoing findings, as set forth in Exhibit A, and in recognition <br />of those facts which are included in the record, the City has determined that the Project would <br />cause the following significant, unavoidable impacts, which are more specifically identified in <br />Chapter 18, section 18.2 of the FEIR: <br /> <br />i. Impact 5-7: Internal Visual Relationship of Project Development to Electrical <br />Transmission Lines. <br /> <br />ii. Impact 6-1: Project-Related Resident Population Growth <br /> <br />iii.
